The Federal High Court, Abuja, on Tuesday granted the request seeking to serve court processes on Nnamdi Kanu and the Indigenous People of Biafra (IPOB) through substituted service.

The court, however, ordered that other respondents in the matter, namely: the Inspector-General of Police, the Commandant General, Nigeria Security and Civil Defence Corps and the Attorney-General of the Federation be served personally.

Justice B.O. Quadri gave the order following an ex-parte application by Mr Richard Ndubuaku for an order of court for substituted service of all the processes of the court on the defendants by publishing them in two national newspapers.

Ndubuaku, who made the application through his counsel, Mr Smart Iheazor, also asked the court to make an order restraining the respondents, whether by themselves, members or agents from disrupting the forthcoming Anambra election.

He also asked the court to make an order restraining Kanu and all members of IPOB from interfering, intimidating and harassing all registered and eligible voters in the Nov. 18 Anambra election.

He further asked the court to prevent Kanu and IPOB from mobilising its members either by threat or undue influence to scuttle the election, pending the determination of the originating summons.

Iheazor told the court that his client premised his application on the grounds that Kanu and IPOB had severally made utterances and threats which were published in newspapers which they had not denied or retracted.

“From the antecedents of Kanu and the activities of IPOB, they are capable of carrying out their threat.

“Serving the processes of this suit on the them by publishing in two national newspapers will bring same to their knowledge as it will be dangerous and difficult to effect personal service on them.

“The applicant has several businesses and business interests and houses in Onitsha and Awka with over 100 staff that will be affected if the threats of Kanu and IPOB are carried out.”

Iheazor further explained that the applicant was almost 70 years old and may lose all his life investments in Awka and Onitsha and may not withstand the destruction of his life long struggle.

The judge, however, only granted the order of substituted service on Kanu and IPOB, and refused all the other reliefs sought by the applicant and asked that all parties in the suit be put on notice.

In refusing to grant the other reliefs sought by Ndubuaku , the judge said that the Federal Government had the capacity to ensure that elections held in Anambra.

He adjourned the matter until Oct. 10 for hearing.(NAN)

This is a good way to implicate a fool who thinks he is smart.

Sit in your house if not interested in voting, but you have no right to prevent the citizens of Nigeria resident in Anambra from voting in a Nigerian election for Anambra.

There will be elections in Anambra, but IPOB has vowed a boycott for its members and apologists, and they will not be missed.

OMG, the article stated ut clearly that they were banning Nnamdi Kanu or anybody from disrupting the S'Elections, but Nnamdi Kanu and IPOB simply said that her members should boycott the elections, in other words to stay away from it as far as possible. Can I possibly stay in my house eating ofe nsala and minding my own business and at the same time disrupting their farce elections?

You are under oath to IPOB and Kanu, others are under oath to their individual freedom and to their country Nigeria.

You don't intend to participate, does not mean election will not hold in Anambra state.

Let IPOB boycott, while Nigerians vote in Anambra.

As for those who say over their dead body, so shall it be.

Anyone seen fomenting any trouble in Anambra on that day instead of sitting in his/her house to eat ofe nsala, is a terrorist that must be shot dead, and shot again to ensure a well deserved death.

Apga agents are unhappy about this because they will be the biggest losers, APGA was created to spearhead the arrival of Biafra but they have abandoned their mandate, therefore we have abandoned them too, so they are just trying to make us go and vote, which is impossible, the best they should be doing now is to campaign vigorously against IPOB to win the hearts and minds of the people, unfortunately they dug their own grave by abandoning us, all these while we voted for them, what did we gain, if not HEAPS OF INSULTS! So we must try something radically different this time around, can you imagine Obiano courting Yakubu Gowon? If any Igbo man does that then he is endorsing Gowon's actions against us, ie giving us the middle finger when we told him to implement the resolutions of the Aburi accord, when we did what we had to do after he ditched the agreement he called on all the world powers to kill our people, that man and his friends deserve the hottest part of hell.

The person that said over his dead body, did he say it on Radio Biafra? Did you hear him say it? Did you hear it from Nnamdi kanu himself? The truth is that All wise Anambra people are wise enough to see that voting in nigeria is tottaly useless, even those abroad are calling their brothers back home to boycott the elections. It is a campaign of minds and hearts and the last time I checked IPOB was leading in the pre election polls.

This is a very legitimate move. Nnamdi Kanu should be careful with this, this is a smart move. Someone close to him should tell him to as early as tomorrow morning file a case with a court of competent jurisdiction challenging the judiciary from subverting his fundamental human right and that of all IPOB members against their freedom of peaceful assembly and of speech. After which he can continue with his crusade until the appelate court grants a stay of proceedings and maintenance of status quo.

This can be beaten peacefully, by filing that counter case tomorrow, because the move is to have a lower court file up fresh little charges against him and get him behind bars for the election to continue. A very smart move here and it can be beaten.
