A businessman was passing through town and having finished his appointed tasks had sought out an attractive lady to be his companion for a little recreational activity.

Having decided upon the amount of remuneration the said lady would receive in consideration of her part in the activities planned, they proceeded to a location to carry out the afore mentioned activities.

However on completion of the services rendered by the lady, the businessman reneged on the deal and refused to complete the transaction by paying the agreed amount!

Unfortunately the activities performed under the agreement between the Lady and the Businessman were, by Law illegal in the state that the agreement was entered into.

So the Lady, feeling rather peeved, decided that the legality of the activities was not a hindrance to her determination to ensure that she received fair remuneration for her time and skills.

The Lady took her grievance to the small claims court and the case came up before a Judge, who accepted the facts of the case as presented, which were:-

That on Tuesday 29 October 2018 Ms Dolly Winthrope entered into a contractual agreement with Mr Harry Grimshaw to rent for a specified period of time, a property owned by Ms Winthrope which she had inherited from her parents.

This property was situated in a quiet depression in a scenic location where a small well was situated surrounded by delicate virgin bushland.

Ms Winthrope alleges that Mr Grimshaw came onto the property in a roughshod manner and proceeded to erect a pump and drill a shaft into the well. Introducing pollutants into a previously pristine environment. Ms Winthrope was most upset and a witness remembers her crying”This is worse than Fracking!”

Ms Winthrope alleges that Mr Grimshaw removed the shaft and pump from the well in an extremely haphazard manner after a mechanical malfunction. Dragging his equipment through the undergrowth and flattening the previously untouched bushland. Ms Winthrope further alleges that Mr Grimshaw left the well considerably wider than it originally was, and with erosion around the perimeter. It became, Ms Winthrope alleges “A danger for small children.”

As Mr Grimshaw did not pay any of the agreed price for rental of the property. Ms Winthrope is seeking payment of the agreed contract price, in addition for the cost of the repair of damage to the property and compensation for the pain and suffering she has endured while having to helplessly look on as her heritage was being desecrated!

The judge ruled in favour of Ms Winthrope and had no Idea that the case was anything other than as presented. A dispute over rental of a parcel of property!
