PRESS RELEASE

APPEAL FOR THE RELEASE OF MR. SEGUN ONIBIYO

It came to light over the weekend, that Mr Segun Onibiyo, Kaduna based online personality and activist, was arrested by men of the Kaduna State Police Command, allegedly over his Facebook posts considered too critical of the Buhari administration.

It was alleged that the Governor of Kaduna State, Governor Nasir El-Rufai, may have been instrumental to his arrest and subsequent detention, even when this has not been proved at all.

Many accounts abound as to the whereabouts of Mr Segun Onibiyo, as to whether he is in police or prison custody, without a court order.

Whereas I do not subscribe to statements and posts that tend to disparage the leadership in any way, our Constitution in its section 39 has guaranteed to every citizen the inalienable freedom of expression and the press. Democracy thrives on free speech, where the right to receive and disseminate information should not be negotiable in any way at all.

However, where the exercise of the freedom of speech may have resulted into the infringement of any known law or a violation of the right of other citizens, the appropriate thing is to follow the due process of law, in dealing with such cases.

Under and by virtue of section 35 of the 1999 Constitution, a citizen of Nigeria should not be in custody beyond 24 hours, without being charged to court for any offense that may be alleged against him. Mr Onibiyo was said to have been arrested on November 23, 2018, in Kaduna and his fate and present location are said to be unknown.

I therefore appeal to the Inspector General of Police, the Commissioner of Police in Kaduna State and Governor Nasir El-Rufai, to direct the immediate release of Mr Onibiyo or ensure that he is arraigned before a competent court of law, for whatever offense that may have been alleged against him.

As we approach the 2019 general elections, it is necessary for our leaders to eschew some level of tolerance and for citizens to exercise restraint in the publication of tendentious and reckless statements, that may heat up the polity and be exploited for other purposes.

Elrufai the midget cannot withstand criticism even when he was a beneficiary of free speech under the last democratic government using all manner of derogatory words.

If apc is allowed another four years they will not only trample on human rights they will also unleash terrorism on the people.

Truly, Gej is a good leader. some of us don't know it until we booted him out. If Buhari could be this brutal in his first term, Nigeria should expect the worst if he mistakingly voted in again. Segun onibiyo is a social media personality and I have been reading his inputs in national discourse, but it's a pity this government hate opposition thereby clamping down on anyone that's against their misrule. Gej said we should pick between light and darkness and to be sincere where in total darkness and it's only God that can have mercy on Nigeria.

You don’t seem like you have a sound reasoning faculty. In the case of criminal or infringing expression? What’s the due process according to the constitution? Are you saying that due process should not be followed? He deserved to be missing since November 23rd. No idea if he’s in police custody or in prison without a court trial.

Its sad that it is happening but still we need to be aware of some facts... there is freedom of exoression but doesnt mean freedom of expression can just be expressed. The government has actually tolerated hate speech from opposition and even from the citizens. We need to know where to stop. While i am condemning the fact that he should not be unlawfully detained, it dossnt stop the fact that he may be used as a scape goat to others on this so called freedom of speech. Can u write a hate speech about the president of USA and u think it u have a freedom of speech. We are lucky that things are not properly subjected to scrutinity. Let us be careful with the way we express ourselves

That is how legal profession works... you can have clients any were in the country...

and the applicable laws enjoins a lawyer to practice in any jurisdiction in Nigeria.

your comment herein lacks substance.... the facts in issue here is the unlawful detention of the suspect and not even the freedom of expression.
if a citizen violates an applicable law the right tin to do is to prosecute the said person and not unlawful detention......the unlawful detention is a violation of s.35 of the 1999 Constitution of Federal Nigeria as amended
