Much as I like the optimism of people and their good analysis, I feel this may be a very big blow to APC's candidates. The supreme court and the Appeal court's ruling on the issue of the primary is clear; you cant be a beneficiary of your own illegality. The court of appeal's judgement-stay of execution for which APC relied on has been declared by the supreme court as inconsequential.
It is very unlikely any stay of execution can help to change the case. Let's wait for the appeal....Sincerely, I do not see APC coming out of this in Rivers State.

Wait for the appeal court judgement to clear your doubts. Tonye Cole will unseat Wike in this election. APC is taking Rivers.

First, this is a federal high court ruling not state high court so I don't understand why you are frothing at the mouth over Governor Wike's name. Secondly, the link I provided was for the judgment of the Court of Appeal not the Supreme Cort so I will correct the error. However, the court of appeal ruled on an appeal filed by Tonye Cole and said judgment has been filed at the Supreme Court which has given a date for the 8th of March for hearing. That would be after elections isn't it? The judgement of the CA remains subsisting. Also remember that on October 22nd the Supreme Court had already affirmed the decision of the Rivers State high court barring the Rivers APC from holding its convention and primaries.

Now this judgment by the Federal High Court is for a suit filed by Magnus Abe, a different party from Tonye Cole (both APC faction candidates); the INEC is now by this judgment effectively barred from receiving anything from APC as far as Rivers is concerned.

This is going to be terrible in that state,the court should not cause brouhaha in Rivers state,APC may create state of emergency scene In that state & both parties may lose at the end..the game pattern will definitely change.. Wike should get ready for a tougher battle. Doubt if they will allow him to campaign even with his barrage of occultic boys ..

Read yourself...then ask yourself whether a superior court has not now overruled the actions of the INEC. Federal high court is completely different from a state high court though they are courts of concurrent jurisdiction.

Did Wike go to court against the APC for anything? Is he the one that created the APC factions in the state or caused Amaechi to quarrel with Magnus Abe? What is the judicial meandering you are talking about?

Explain how this judgement is unenforceable??

If you say it's because inec has already recognised cole, let me ask you this; if property of be it tangible or intangible, or a title is obtained by fraud or through an irregularly means, does the court not have jurisdiction to set it aside and pronounce and action arising out of such fraud or irregularities null and void??
