The team of Defence Counsel led by Chief Wole Olanipekun(SAN) representing the CJN, Hon. Justice Walter Onnoghen at the CCT has filed a Preliminary Objection challenging the jurisdiction of the CCT to hear the matter.

PT: During his maiden media chat, President Muhammadu Buhari had said you have the power to release his asset declaration document to us in PREMIUM TIMES. Would you be willing now to release the documents to us, just as the president said on live television?

I will give you a very simple answer. He said you are free but who is free? Is the CCB free? The law does not say I should release anybody’s asset declaration. The document does not become public document after declaration, it is only the CCB that is allowed by the constitution to retain custody of such documents. That is what the CCB Act says.


Besides, Schedule 3, Paragraph 3 (c) of the 1999 Constitution as amended says the bureau shall have power to retain custody of such declarations and make them available for inspection by any citizen of Nigeria on such terms and conditions as the National Assembly may prescribe.

PT: But if you encourage it and President Buhari said on national television that you have powers to release his own document, don’t you think you would be standing on the way of probity and transparency you are talking about?

Going by the afore precedence, the curious questions for this APC government, CCB and the petitioners are:

-1).How did the petitioner accessed the CJN's asset declaration forms @ the CCB since only the declearer is allowed by law to order the CCB to allow public access to such info contain therein?


Just as Cambridge Syndicate replied that only Buhari have the right to authorized the release of his alleged certificate who conducted the then exam on behalf of WAEC.

-2).Is it no clear & certain that the CCB & petitioner committed a grave criminal breach of trust & thereby violate the right of privacy of the CJN by this malicious act?

-3).Why did the FG/presidency via the morally corrupt AGF bypassed the NJC protocol, does the CCT have any juridiction to trial a judicial officer without the NJC's approval? Why did the FG asked the CJN to vacate office when he have not been tried or found wanting?


Why wait till the eve of a crucial election wherein the president Is a stakeholder before this "prosecutorial misadventure" according to Mr.Femi Falana? Is the govt not obviously up to sometime sinister?

-4).Why did the corrupt & morally depraved APC-govt hasten up this show of shame with supersonic speed while the same regime have annoying footdragged on the numerous corrupt indictment of many top & low members of its fold up till date?


The most sensational is the bias failure of the EFCC to investigate the Gov.Ganduje dollar bribe scandal? The government have simply took on more than it can contain.

I still strongly belief that all the FG desire to achieve from this trial is to discredit and unstettle the CJN ahead of the already envisaged litigations from disputed elections.

Clearly, this case won't end anytime soon.

We have more pressing issues in the country please.

CCT is not trying him for professional negligence but for criminal acts . Governors grow up. Gone are the days of cabals. If you do the crime do the time. This is the big change we voted for.
CJN Salary/Annum = N9,012,000 CJN savings in Foreign Accounts alone = N250,500,000. Does he trade in Judgements?

It took the Buhari Govt a long time to confirm the CJN appointment on the ground that they are conducting background checks.

After conducting Bbackground checks, u appointed someone who didn't declare his assets and u waited till election eve to remove him.

The speed and ease at which they follow this case shows their sinister motive, but they will fail.

Buhari, u are a failure and you need someone to tell you that

actually there is no way the executive arm of govt will armtwist the judiciary
it is considered judicially impossible for a lower court to even oversee or overturn a ruling of a superior. court (federal court of appeal for that matter)
