Ridiculing Of The Judiciary by briefness: 11:49pm On Jan 26, 2019
The judiciary the say, is the last hope for the common man. It remains a unique arm of government and requires the highest qualification as compared to other arms of government. This should have given much credence as it will be assumed that any decision to be taken will properly guided. The judiciary is also expected to display a high level of integrity as it has the power of life and death.

The President suspended the CJN and the constitutionality and legality of such a decision is being debated. Also of great concern is the timing of the decision due to the forth coming general elections. At the same time, the integrity of the person of the CJN who is the head of the judiciary is being questioned over the non declaration of some of his assets which he reportedly admitted he forgot to declare. Bare in mind that if what is being reported is true, the assets forgotten to be declared could be much more in value compared to what was declared.

With the weight of the allegation, despite the sentiments, the judiciary should not have allowed itself to be ridiculed. The judiciary should have been courageous enough to take the necessary step, take the right actions to ensure fair hearing and as well prevent interference.

The indefinite postponement of the NJC meeting where the issue would have been raised and perhaps the decision taken in that meeting would have put the situation under control. Did the judiciary ridicule itself by the postponement, moreso without a reason? Could it have been a smart game of survival for the meeting to have been postponed by the Chairman who is the CJN?

For the judiciary, a stitch in time would have saved nine and prevented all this confusion if they had reflected on the very principle of Lady Justice, the symbol of Law. Lawyers and Judges must do everything possible to keep their profession noble to safeguard it from undue interference especially by politicians.

A corrupt judiciary is a threat to the very existence of any nation.

Moreso if the judiciary is perceived to be shielding itself and preventing due process. The judiciary should always act swiftly whenever the situation demands and clear the air on impunity within. If there was pressure from within to hold the NJC meeting, the situation probably would have been better guided.

The only way to clean the judiciary or handle the CJ issue is to allow the CJ as the head of the NJC to investigate himself and recommend his own suspension and dismissal to the president for immediate dismissal.

Meaning we should let armed robbers be their own lawyer, prosecutor, and judge at the same time.

This is how rettarded the CJ issue is?

Just imagine, the CJ and the head of the NJC is on trial for corruption.

There are countless judges on trial for corruption

So where is the democracy we keep talking about? The one that sends the mobile phone thief to prison for years and let crooked and corrupt public officials walk away free with their stole millions and billions.

This is the fault of the judiciary because they've been getting away with corrupt judgments and financial inducements from corrupt public officials for decades, but they didn't see this coming and even after the whole thing broke, they should have suspended the CJ or at least plead with him to step down, but they deployed the same old crooked and corrupt tactics where they commandeered their corrupt friend in different courts to issue endless injunctions, delays and frivolous jurisdiction nonsense.

They need to clean house, seriously.

Femi Falana(SAN) has said the Code of Conduct Tribunal’s order relied on by President Muhammadu Buhari to suspend the Chief Justice of Nigeria, Walter Onnoghen, is suspect.

Justice Tanko Muhammad has been sworn in by the president as the Ag. CJN following charges of false assets declaration filed against Onnoghen.
According to Falana, the exparte application relied on was filed on January 9 while the motion on notice of the substantive suit filed on January 11 with the name of the lawyer that argued the exparte motion not stated in the order.

He also suggested that Onnoghen might have contributed to his own downfall by postponing indefinitely the meeting of the National Judicial Council, which could have deliberated on the matter and take an informed position.
The Senior Advocate stated this in a statement made available to PUNCH on Saturday in Abuja.
Falana recalled he had tried to intervene in the matter by calling on the Attorney-General of the Federation, Abubakar Malami SAN to withdraw the charge of false declaration of assets filed against the suspended CJN.

The statement read, “The call was without prejudice to the merit of the serious allegations levelled against the Chief Justice. In line with decided judicial authorities, I had wanted the National Judicial Council to investigate the allegations. Unfortunately, the 88th statutory meeting of the National Judicial Council scheduled to hold on January 15, 2019, which could have deliberated on the matter and taken an informed position was postponed indefinitely on the directive of the embattled Chief Justice.
“As the battle shifted to the courts, both the Judiciary and the Executive were shopping for court orders from the Federal High Court, the National Industrial Court, the Code of Conduct Tribunal and the Court of Appeal. In the process, settled principles of law were sacrificed for the exigency of the moment.”

Stating that the ex parte order was procured in an act of brazen impunity by the Executive, Falana urged the president to respect all orders of the court earlier obtained which restrained the Federal Government from removing the CJN.

“It is unfortunate that the Bar and the Bench have played into the hands of the sponsors of incipient fascism in the country. For reasons best known to them.”
Therefore, the National Judicial Council should convene and constitute a committee to investigate the allegations leveled against the Chief Justice and make appropriate recommendation to the relevant authorities.
