The sooner we dump this 1999 criminal constitution the better for us all, people believe it is some kind of moses law, or it was written by angel gabriel and his angelic legal team, meanwhile it was arranged by abacha's suppreme military council headed by abdulsalam and some corrupt politician to protect massive looting and give them immuinity. Same law that favors the Rich and criminalises the poor, yet it is our tax and resources that made them rich.

Justice Onoghen, for the right of the many nigerians you had setenced to death with your judicial powers after deciding their fate based on available facts... For the sake of Right and Wrong, and for the sake of not further heating Nigerian polity, kindly quickly explain the source of your over 55 houses and billions in .your account. Many youths went to school, shunned, cultism, yahoo yahoo, ritualism and oloshoism for their fate in the system. Let me start by quoting the classic philosopher Aristotle- "It is more proper that law should govern than any one of the citizens". Plato on the other hand saw the defence of the Rule of Law as the best possible political order.

The above corroborates the certitude that the notion of the efficiency, competence, and supremacy of the law has been known for aeon years.
Following wicked King John's penchant for bringing disrepute, ignominy and his constant disregard of the rights of the English people, the barons eventually succeeded in creating that single document capable of checking the powers of the tyrant leader; thus was born "The Great Charter" on the 15th of June, 1215.

Since the birth of the Magna Carter, Judicial systems all over the world have been fortified and toughened by the authority and influence of law in society, especially when the law is viewed as a constraint on individual and institutional behavior.

In 1789, In his two Treatises on Government, John Locke disclosed that the impending danger inherently laden in consolidating the three organs of state in the hands of one, might be cataclysmic.
Now to the draconian antics of the Muhammadu Buhari led federal Government.

Throughout the year 2018, on various instances, we witnessed the Buhari led federal government make intrepid attempts to hijack the Legislative arm of Government.
We saw desperate attempts to change the leadership of both houses via the back door; what many will term a "legislative coup".
We saw federal government sponsored lawmakers desecrate the hallowed chambers.

We witnessed the president's seceret police lay siege to the National assembly complex, we have seen the president go after vociferous legislators for mustering the effrontery to speak out against the Govenrment. We even witnessed the National chairman of the president's party publicly offer salvation and freedom from prosecution to corrupt politicians once they joined the ruling APC.

With the legislature failing to cave in, the Buhari led federal government has shifted its focus to the judiciary.
On countless occasions, having flagrantly violated orders of various trial courts, the retired general has constantly shown little regard for the rule of law.

The position of the law regarding the removal of the Chief Justice of Nigeria remains clear; wherein removal could be interpreted as replaced, suspended, fired or whatever choice of word you so prefer.
Section 292 (Constitution of the federal republic of Nigeria, 1999).

“A judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances;
(a) in the case of –
"Chief Justice of Nigeria, President of the Court of Appeal, Chief Judge of the Federal High Court, Chief Judge of the High Court of the Federal Capital Territory, Abuja, Grand Kadi of the Sharia Court of Appeal of the Federal Capital Territory, Abuja and President, Customary Court of Appeal of the Federal Capital Territory, Abuja, by the President acting on an address supported by two-thirds majority of the Senate.”
(ii) Chief Judge of a State, Grand Kadi of a Sharia Court of Appeal or President of a Customary Court of Appeal of a State, by the Governor acting on an address supported by two-thirds majority of the House of Assembly of the State, Praying that he be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct;

(b) in any case, other than those to which paragraph (a) of this subsection applies, by the President or, as the case may be, the Governor acting on the recommendation of the National Judicial Council that the judicial officer be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct."

The president and his handlers have not exploited a constitutional lacuna as they claim, but have simply gone against the rules; however since this is not the first, i am far from shocked.

Muhammadu Buhari's despotic tendencies are very well known. With his tacit admission to compromising the integrity of the independent national electoral commission, and now in a despairing attempt to manipulate the results of the coming elections, he has gone ahead to contravene our constitution and to debase the Judiciary by unconstitutionally desecrating the office of the Chief Justice of Nigeria.

This is a wake up call to all lovers of democracy and liberty. There is a shadow of gloom cast over Nigeria's democratic process. These signs are ominous, the future is bleak!

I close by paraphrasing British wartime foreign Secretary "Sir Edward Grey". "The lamps are going out all over Nigeria, we may never see them lit again in our time".

Your analysis is bias. Yes the west recognizes the opposition candidate. Why don't you talk about maduro's very strong allies sitting on the sideline and watching carefully after warning the United States to stay off. You talk about sanctions as if it's oxygen. Many countries have various sanctions and embargoes yet they are avoiding it and yet attaining self sustenance. I'm not a supporter of high handedness but when you want to quote issues be very clear and not just pick what appeals to you alone to buttress your point. There isn't any centralized force in the world right now so not everything revolves around the US, EU and what have you.

Ok. Let me give you an inkling of what will likely happen in Nigeria if Buhari and APC rig the 2019 election.

You have read the statements put out by the United States and the United Kingdom earlier on Thursday the 24th of January where both countries specifically warned against the rigging of the election and promised visa sanctions and even international prosecution for those who will be caught or indicted in the rigging of the election. Those who don't know or those who are so blind that they can't see, think that the statements by those countries are empty boasts. Let anyone in INEC, the security agencies and in the federal or state governments even try to rig this election and see. The international observers are coming in huge numbers more than ever before after reading the reports of the shame and sham in Osun State. The word has spread round and they are coming with a large delegation to observe the elections.

It's such a shame that the perceived gains of our electoral advancement in 2011 and debatably in 2015, have been eroded by the selfish and evil machinations of a desperate self-serving cabal.

With the US and the UK releasing warnings to Nigeria about electoral malpractices, it doesn't take much to look at what has been happening in Venezuela in the past three days or so.

In Venezuela, the leader of the opposition party ran for the Presidency with the incumbent President. The election was heavily rigged in the incumbent's favour and the international observers from the European Union and other countries, including the USA, reported the malpractices in that election to their home countries.

And what has happened?

President Trump of America a few hours ago duly recognised the opposition party leader as the President of Venezuela. Trump says the election was rigged and that the incumbent has to leave. What has followed? The European Union, Canada and other countries have also recognised the opposition party leader as the rightful President-in-waiting. Trump and the other countries have directed that all oil proceeds due to Venezuela be kept in a special account and will not be sent to Venezuela till the opposition candidate is rightfully sworn in. Trump has also agreed that the opposition leader can form his cabinet which the international community has agreed to recognise.

This means that the Venezuelan opposition party leader is now a President in the eyes of the world, while the incumbent president in his country is screaming blue murder. The opposition President will be given the status of an international Head of State and will be thus recognised. It's only a matter of time before the incumbent in Venezuela either accepts defeat or is removed by the people's protest when biting economic sanctions hit very soon.

How does this relate to the February election in Nigeria? Only the discerning can see what will happen.

If Buhari and INEC and the security agencies attempt to rig the election and results which do not reflect the will of the voters are declared, Nigeria should prepare themselves for the Venezuelan treatment.

Every Nigerian should be asking for right now is for free and fair elections in Nigeria. Let the people's will prevail.

It won't take one month of sanctions on us before the reality of what the effects of a rigged election on our economy and national psyche hit home.

The law is made for man and not man for the law. In other words the law is made to control man and not for man to control the law. I pity the next generation.

The question to ask is can the president suspend or remove any arm of govt unilateral. Some day in the future we will see a president suspend or remove the Senate president on the ground that he does not do his bidden and nothing will happen

your submission is right but what happened in Venezuela can't happen here bcoz buhari will beat Atiku with wide margin without rigging if you say this in 2015 when buhari was in opposition I would have support your motion am not among buhari fans but saying the truth of what I know,,, Justice Onoghen would have done normal thing when he was declaring his asset by declaring all without forgetting any hiding account undeclared somewhere by now nobody would have removed him although federal government would have followed due process but as its now the deed has been done, I can't support corrupt individual follow rules of law or not, thief is thief.

Now it is the turn of the Chief Justice of Nigeria, Walter Onnoghen, who admitted himself that he 'forgot' to declare his domiciliary accounts which was loaded with £23,409, €49,971 and $391,401, including 55 houses undeclared, and by so doing, he breached the Code of Conduct as a Public officer and was suppose to have resigned straightaway if he had any modicum of honour, integrity and shame as the custodian of the Nigerian Law, but he didn't. Instead, he was doing everything to stall his trial at the Code of Conduct Tribunal. All those times, you didn't call for his resignation the same way you did with Kemi, you didn't bully him to resign the way you bullied Kemi, you were instead urging him to stay on, you were drumming support for him and some of you that were deceiving yourselves with your forming neutrality didn't say anything all this while too, you deliberately turned dumb. When it was first revealed a fortnight ago that the Chief Justice of Nigeria didn't declare his domiciliary accounts with dollars starched in it, all you were vituperating was that the President wanted to remove him because he's a southerner. You acted dumb on the offence he committed. Now that the CJN has been suspended, those of you fake neutralists are now crying foul. You're screaming that democracy is in danger. Just a couple of days ago, another $630,000 and $800,000 was discovered in his separate domiciliary accounts again. Y'all pretended you didn't see the news, abi? Sensing that he could be suspended by the NJC, the CJN quickly suspend their meeting indefinitely. Why? So that he can stay on. You can imagine!
You asked Kemi to resign but Onnoghen who was selling justice for dollars and deliberately didn't declare those dollars in his domiciliary accounts including 55 houses should stay on, and he should be left alone.

The NJC is a body of jurist and not a one man show, if he is the chairman,I'm sure they will be a vice or secretary who will be more than glad to take his place if he is found wanting.

I'm aware the CJN postponed its meeting and the reason was because of the armed forces remembrance day which falls on the same date and the CJN also has to be present at the state house for the parade,besides how is postponement of their meeting supposed to be your business last time I checked they aren't answereable to anyone,if the senate of a university postpones its meeting for any reason whatsoever does it mean a SUG president can then suspend or rusticate a fellow student because they are taking too long for his liking?

Do u know the CCT gave an ex parts order out of the blues after the case had been adjourned till the 28th as at the last hearing.

What is Onnoghens crime=He failed to declare assets years ago

What is the penalty, If u admit to an ommision due to negligence u are given the opportunity to update your form and everyone goes home smiling.

How come he is been suspended when the penalty doesn't even call for such at all.

Perhaps u are the one that needs to go back the educational institution u attended to get a refund if u still can't wrap your head around this.

Its quite funny when a minister of communication says he thinks been an honourable member of the state house equals to the mandatory one year youth service,however I never heard the echoes of resignation from your likes then but why now after Onnoghen duly declared in 2015 before he was CJN that should be enough,why need to time travel to 09 except for mischief.

I know there is no penalty because fortunately im an ignoramus like u.

In Justice Salami case he was suspended and recommended for compulsory retirement by the NJC and not the president,that's all we asking of,he should go the right have and petition the NJC and not some jankara purchase of an acting CJN,how hard can that be.

Like I said the CJN does not need to reply the CCT at all because its not within their jurisdiction to prosecute, its akin to a college head boy canning a corper for coming late to class.

You have read the statements put out by the United States and the United Kingdom earlier on Thursday the 24th of January where both countries specifically warned against the rigging of the election and promised visa sanctions and even international prosecution for those who will be caught or indicted in the rigging of the election. Those who don't know or those who are so blind that they can't see, think that the statements by those countries are empty boasts. Let anyone in INEC, the security agencies and in the federal or state governments even try to rig this election and see. The international observers are coming in huge numbers more than ever before after reading the reports of the shame and sham in Osun State. The word has spread round and they are coming with a large delegation to observe the elections.

It's such a shame that the perceived gains of our electoral advancement in 2011 and debatably in 2015, have been eroded by the selfish and evil machinations of a desperate self-serving cabal.

With the US and the UK releasing warnings to Nigeria about electoral malpractices, it doesn't take much to look at what has been happening in Venezuela in the past three days or so.

In Venezuela, the leader of the opposition party ran for the Presidency with the incumbent President. The election was heavily rigged in the incumbent's favour and the international observers from the European Union and other countries, including the USA, reported the malpractices in that election to their home countries.

And what has happened?

President Trump of America a few hours ago duly recognised the opposition party leader as the President of Venezuela. Trump says the election was rigged and that the incumbent has to leave. What has followed? The European Union, Canada and other countries have also recognised the opposition party leader as the rightful President-in-waiting. Trump and the other countries have directed that all oil proceeds due to Venezuela be kept in a special account and will not be sent to Venezuela till the opposition candidate is rightfully sworn in. Trump has also agreed that the opposition leader can form his cabinet which the international community has agreed to recognise.

This means that the Venezuelan opposition party leader is now a President in the eyes of the world, while the incumbent president in his country is screaming blue murder. The opposition President will be given the status of an international Head of State and will be thus recognised. It's only a matter of time before the incumbent in Venezuela either accepts defeat or is removed by the people's protest when biting economic sanctions hit very soon.

How does this relate to the February election in Nigeria? Only the discerning can see what will happen.

If Buhari and INEC and the security agencies attempt to rig the election and results which do not reflect the will of the voters are declared, Nigeria should prepare themselves for the Venezuelan treatment.

Every Nigerian should be asking for right now is for free and fair elections in Nigeria. Let the people's will prevail.

It won't take one month of sanctions on us before the reality of what the effects of a rigged election on our economy and national psyche hit home.

A word is enough for the wise.

Its what have thought and delibrated on. I see many people dont know the power of the international community especially when it has to do with the democratic nations. If you follow what � has said it is closely looking like what is happening in Venezuela but in another form. Lets note that in the international community PMB does not have a good democratic record being that he was once a military head of state ( Obasanjo was wiser in handing over ). So any move that looks like an act against democracy may have fatal consequences for us all especially if there is resentment from the populace and mind you its national interest first at international poliitics.

kindly stop misleading people if you don't have your facts right. Guaido never ran for presidency in Venezuela, Maduro banned the opposition from participating in the election and ran unopposed , he won by 67% and was sworn in last week. the international observers view this as a vacancy in the presidency because there was no contest. the constitution of Venezuela empower the Leader of their unicameral legislature to take over as interim president and organise election within 30days.... while I did not support excessive use of power, the West can do nothing to any formidable country, Russia, China, Turkey, and other anti-west countries already support Maduro. all na politics

No one is saying the CJN is not guilty,at least we are all Nigerians ,we know what's up with government officials and kick backs,but let the law ,which we all respect,take it's course.

If the CJN is not respecting the law, why should the common man or anyone else obey the same law you talk about?
