Mr man, the constitution gave 2ways that a CJ can be removed... Two ways! Nothing more, nothing else...One way failed, can't you try the second way? Intact, even the head of the CCT has a corrupt case hanging on his neck o. But lets overlook that one, cos he is doing our bidding..lol. Just chill man. Are you not aware that the CJN is the chairman/president of the NJC?

Are you also not aware that CJN indefinitely postponed a meeting that's supposed to be held by the NJC members because of the allegation against him?

Do you not know that this same CJN gave a ruling about the role of the CCT/CCT to the conduct of judicial officers and the allegation against him falls within?

If someone is not guilty of a crime why would such person want an injunction ?

The NJC is a body of jurist and not a one man show, if he is the chairman,I'm sure they will be a vice or secretary who will be more than glad to take his place if he is found wanting.

I'm aware the CJN postponed its meeting and the reason was because of the armed forces remembrance day which falls on the same date and the CJN also has to be present at the state house for the parade,besides how is postponement of their meeting supposed to be your business last time I checked they aren't answereable to anyone,if the senate of a university postpones its meeting for any reason whatsoever does it mean a SUG president can then suspend or rusticate a fellow student because they are taking too long for his liking?

Do u know the CCT gave an ex parts order out of the blues after the case had been adjourned till the 28th as at the last hearing.

What is Onnoghens crime=He failed to declare assets years ago

What is the penalty, If u admit to an ommision due to negligence u are given the opportunity to update your form and everyone goes home smiling.

How come he is been suspended when the penalty doesn't even call for such at all.

This shouldn't be a PDP or APC thing,but simply the respect and obedience to a constitution,believe me ,every lawyer I've spoken to ,wants the CJN in jail,but their main issue is that a lot of serving members of the ruling APC have pending cases with the EFCC and are walking freely.....while this very case was done and dusted in less than a week.

No one is saying the CJN is not guilty,at least we are all Nigerians ,we know what's up with government officials and kick backs,but let the law ,which we all respect,take it's course.

We need to as nation kill sentiments attached to party affilliations,tribe and religion,if we want to remain as one,or we kukuma tell ourselves the truth and go our separate ways,we cannot continue like this honestly.....I came back from Ghana last week,yes cost of living is a bit high ,but this guys have gradually made their country a Haven for every one....you see Chinese settlements , Korean settlement and a new afro American settlement is coming up at the vollta regions..... every one wants to come to Ghana .

The charge against the Chief Justice of Nigeria, Justice Walter Onnoghen ought not to have been instituted at the Code of Conduct of Tribunal in view of the case of Nganjiwa v FRN (2017) LPELR 43391 wherein the Court of Appeal held that a judicial officer who has not been investigated by the National Judicial Council and sanctioned for misconduct cannot be arraigned in any criminal court in Nigeria.

In other words judicial officers also enjoy immunity from been prosecuted,I hope I have made myself elementary enough for simpletons like u.

Which NJC? The one that he's their president and he didn't allow their meeting to take place this month, 2 days ago. Why? And he wouldn't have allowed it to take place next month or the one after. The man is simply a crook.

on the case of court asking him to step down? that is not what the constitution said. the constitution is very clear on what must be done, if he didn't let the njc sit, he is only extending the inevitable and making matters worse for himself

In 1789, In his two Treatises on Government, John Locke disclosed that the impending danger inherently laden in consolidating the three organs of state in the hands of one, might be cataclysmic.
Now to the draconian antics of the Muhammadu Buhari led federal Government.

Throughout the year 2018, on various instances, we witnessed the Buhari led federal government make intrepid attempts to hijack the Legislative arm of Government.
We saw desperate attempts to change the leadership of both houses via the back door; what many will term a "legislative coup".
We saw federal government sponsored lawmakers desecrate the hallowed chambers.

We witnessed the president's seceret police lay siege to the National assembly complex, we have seen the president go after vociferous legislators for mustering the effrontery to speak out against the Govenrment. We even witnessed the National chairman of the president's party publicly offer salvation and freedom from prosecution to corrupt politicians once they joined the ruling APC.

With the legislature failing to cave in, the Buhari led federal government has shifted its focus to the judiciary.
On countless occasions, having flagrantly violated orders of various trial courts, the retired general has constantly shown little regard for the rule of law.

The position of the law regarding the removal of the Chief Justice of Nigeria remains clear; wherein removal could be interpreted as replaced, suspended, fired or whatever choice of word you so prefer.
Section 292 (Constitution of the federal republic of Nigeria, 1999).

“A judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances;
(a) in the case of –
"Chief Justice of Nigeria, President of the Court of Appeal, Chief Judge of the Federal High Court, Chief Judge of the High Court of the Federal Capital Territory, Abuja, Grand Kadi of the Sharia Court of Appeal of the Federal Capital Territory, Abuja and President, Customary Court of Appeal of the Federal Capital Territory, Abuja, by the President acting on an address supported by two-thirds majority of the Senate.”
(ii) Chief Judge of a State, Grand Kadi of a Sharia Court of Appeal or President of a Customary Court of Appeal of a State, by the Governor acting on an address supported by two-thirds majority of the House of Assembly of the State, Praying that he be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct;

(b) in any case, other than those to which paragraph (a) of this subsection applies, by the President or, as the case may be, the Governor acting on the recommendation of the National Judicial Council that the judicial officer be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct."

The president and his handlers have not exploited a constitutional lacuna as they claim, but have simply gone against the rules; however since this is not the first, i am far from shocked.

Muhammadu Buhari's despotic tendencies are very well known. With his tacit admission to compromising the integrity of the independent national electoral commission, and now in a despairing attempt to manipulate the results of the coming elections, he has gone ahead to contravene our constitution and to debase the Judiciary by unconstitutionally desecrating the office of the Chief Justice of Nigeria.

This is a wake up call to all lovers of democracy and liberty. There is a shadow of gloom cast over Nigeria's democratic process. These signs are ominous, the future is bleak!

I close by paraphrasing British wartime foreign Secretary "Sir Edward Grey". "The lamps are going out all over Nigeria, we may never see them lit again in our time".

The sooner we dump this 1999 criminal constitution the better for us all, people believe it is some kind of moses law, or it was written by angel gabriel and his angelic legal team, meanwhile it was arranged by abacha's suppreme military council headed by abdulsalam and some corrupt politician to protect massive looting and give them immuinity. If buhari was a credible leader, an impartial leader I’m sure he would have gotten the support he needs from the senate or others to act according to the rule of law or even onnoghen himself would have seen himself dishonorable.

It was postponed for armed forces Remembrance Day 15th January, why do you guys forget that. It wasn’t postponed indefinitely. They wld sit and the petitioner has to forward their petition there otherwise it wldnt be considered. That’s due process.

Ok. Let me give you an inkling of what will likely happen in Nigeria if Buhari and APC rig the 2019 election.

You have read the statements put out by the United States and the United Kingdom earlier on Thursday the 24th of January where both countries specifically warned against the rigging of the election and promised visa sanctions and even international prosecution for those who will be caught or indicted in the rigging of the election. Those who don't know or those who are so blind that they can't see, think that the statements by those countries are empty boasts. Let anyone in INEC, the security agencies and in the federal or state governments even try to rig this election and see. The international observers are coming in huge numbers more than ever before after reading the reports of the shame and sham in Osun State. The word has spread round and they are coming with a large delegation to observe the elections.

It's such a shame that the perceived gains of our electoral advancement in 2011 and debatably in 2015, have been eroded by the selfish and evil machinations of a desperate self-serving cabal.

With the US and the UK releasing warnings to Nigeria about electoral malpractices, it doesn't take much to look at what has been happening in Venezuela in the past three days or so.

In Venezuela, the leader of the opposition party ran for the Presidency with the incumbent President. The election was heavily rigged in the incumbent's favour and the international observers from the European Union and other countries, including the USA, reported the malpractices in that election to their home countries.

And what has happened?

President Trump of America a few hours ago duly recognised the opposition party leader as the President of Venezuela. Trump says the election was rigged and that the incumbent has to leave. What has followed? The European Union, Canada and other countries have also recognised the opposition party leader as the rightful President-in-waiting. Trump and the other countries have directed that all oil proceeds due to Venezuela be kept in a special account and will not be sent to Venezuela till the opposition candidate is rightfully sworn in. Trump has also agreed that the opposition leader can form his cabinet which the international community has agreed to recognise.

This means that the Venezuelan opposition party leader is now a President in the eyes of the world, while the incumbent president in his country is screaming blue murder. The opposition President will be given the status of an international Head of State and will be thus recognised. It's only a matter of time before the incumbent in Venezuela either accepts defeat or is removed by the people's protest when biting economic sanctions hit very soon.

How does this relate to the February election in Nigeria? Only the discerning can see what will happen.

If Buhari and INEC and the security agencies attempt to rig the election and results which do not reflect the will of the voters are declared, Nigeria should prepare themselves for the Venezuelan treatment.

Every Nigerian should be asking for right now is for free and fair elections in Nigeria. Let the people's will prevail.

It won't take one month of sanctions on us before the reality of what the effects of a rigged election on our economy and national psyche hit home.

A word is enough for the wise.

First of All PMB does not need to rig in order to win this election.

Secondly, Nigeria is not Venezuela, Trump cannot imposed Atiku on us, we shall resist every attempt to do so even if we have to burn down the whole country.

If Atiku can beat Buhari then fine, if not, try and do any gra gra when you guys loose & We shall use that opportunity to exterminate ALL d political elites in this country & thier cronies like you, bbq guy, slamrush etc.

Almost everyone on social media voiced former Finance Minister Kemi Adeosun into resigning. Some even asked that the President remove her to prove that he's truly fighting corruption. Now it is the turn of the Chief Justice of Nigeria, Walter Onnoghen, who admitted himself that he 'forgot' to declare his domiciliary accounts which was loaded with £23,409, €49,971 and $391,401, including 55 houses undeclared, and by so doing, he breached the Code of Conduct as a Public officer and was suppose to have resigned straightaway if he had any modicum of honour, integrity and shame as the custodian of the Nigerian Law, but he didn't. Instead, he was doing everything to stall his trial at the Code of Conduct Tribunal. All those times, you didn't call for his resignation the same way you did with Kemi, you didn't bully him to resign the way you bullied Kemi, you were instead urging him to stay on, you were drumming support for him and some of you that were deceiving yourselves with your forming neutrality didn't say anything all this while too, you deliberately turned dumb. When it was first revealed a fortnight ago that the Chief Justice of Nigeria didn't declare his domiciliary accounts with dollars starched in it, all you were vituperating was that the President wanted to remove him because he's a southerner. You acted dumb on the offence he committed. Now that the CJN has been suspended, those of you fake neutralists are now crying foul. You're screaming that democracy is in danger. Sensing that he could be suspended by the NJC, the CJN quickly suspend their meeting indefinitely. Why? So that he can stay on. You can imagine!
You asked Kemi to resign but Onnoghen who was selling justice for dollars and deliberately didn't declare those dollars in his domiciliary accounts including 55 houses should stay on, and he should be left alone.

If buhari was a credible leader, an impartial leader I’m sure he would have gotten the support he needs from the senate or others to act according to the rule of law or even onnoghen himself would have seen himself dishonorable.

U cannot call onnoghen corrupt and call Ganduje a saint and say Ure fighting corruption or standing for justice. U lost ur Moral right to fight corruption and ur actions cannot be trusted. Follow the constitution is the best We can accept from u.
