Falana writes Buhari govt to withdraw the case against Onnoghen

A Lagos lawyer and Human Rights Activist, Femi Falana (SAN), has urged the Federal Government to withdraw the criminal charges filed against the suspended Chief Justice of Nigeria, Walter Onnoghen.

Falana said he made the request having confirmed that a petition had been submitted to the National Judicial Council alleging grave misconduct against Onnoghen.

February 3 letter addressed to the Attorney General of Federation and Minister of Justice, Abubakar Malami, Falana urged him to advise President Muhammadu Buhari to reverse the suspension because a public officer could not be removed from office on the basis of an ex parte order granted by any Court or Tribunal in Nigeria.

The letter read, “Since the charge of false declaration of assets was filed against the Chief Justice of Nigeria, Justice Walter Onnoghen at the Code of Conduct Tribunal, by the Code of Conduct Bureau, I have repeatedly requested you to use your good offices to discontinue the case. My request was anchored on the case of Elelu-Habeeb v Attorney-General of the Federation & Ors (2012) 40 WRN 1 where the Supreme Court held that by virtue of Section 292 of the Constitution of Nigeria the head of any of the judicial arms of State and Federal Governments cannot be removed from office without a prior investigation conducted by the National Judicial Council.

“Having confirmed that you have since submitted a petition to the National Judicial Council alleging grave misconduct against the Chief Justice, I am compelled to request you, once again, to file a nolle prosequi to discontinue the charge pending against his Lordship at the Code of Conduct Tribunal without any further delay.

“The charge should not be allowed to hang like a Sword of Damocles on the head of the Chief Justice while he is being investigated by the National Judicial Council. In view of your implicit confidence in the ability of members of the National Judicial Council to resolve the matter you ought to accede to the request to terminate the proceedings at the Code of Conduct Tribunal forthwith.”

Falana posited that the withdrawal of the case from the Code of Conduct Tribunal would lead to the immediate vacation of the ex parte order relied upon by the President to justify the illegal suspension of Onnoghen and the appointment of Justice Tanko Mohammad as Acting Chief Justice of Nigeria.

“Even though by virtue of Paragraph 10 (2) (a) of Part 1 of the Fifth Schedule to the 1999 Constitution (as amended) the Code of Conduct Tribunal is empowered to order any public officer to vacate office the power cannot be exercised until such a public officer has been tried and convicted for breaching the provisions of the code of conduct for pubic officers.

“But as a public officer cannot be removed from office on the basis of an ex parte order granted by any Court or Tribunal in Nigeria we urge you to advise President Buhari to reverse the suspension of the Chief Justice.

“Once the suspension is reversed Justice Walter Onnoghen will then be prevailed upon to resign as the Chief Justice having lost the moral authority to preside over the affairs on the juridical organ of the Government of the Federation.

“However, if his Lordship does not call it quits or if the National Judicial Council does not recommend his removal from office you may wish to exercise your powers under section 174 of the Constitution to prosecute him for failure to declare his assets which is a punishable offence under the Code of Conduct Bureau and Tribunal Act.

No one is withdrawing nothing! The case must be pursued to a logical conclusion. angry

Onnoghen has said he wants to see to the end of the case in court of law and so shall it be. Falana cab go to be rest assured justice will be served.

That said, my fellow Igbos and lovers of freedom, we must be steadfast as the zoo elections draw closer. There has been a Cameroonian masquerading as a lover of Ndigbo who once used his influence as vice president to steal a part of Biafran territory and added same to his country.

His name is Ati'aku Frimpong Al'Camerooni, popularly called Atiku Abubakar in Nigeria.

Our great leader Ohamadike Mazi Nnamdi Kanu made this great revelation two days ago. He has also announced the date is Biafran referendum which coincides with the date of the zoo elections. He has asked that we sit at home and be counted while Afonjas go ahead and do their nonsense in the zoo.

In order for Ati'aku to prove Ohamadike wrong, he must remove his trousers let's examine the tattoo on his right thigh! His real name is clearly written there!

God bless Ohamadike and all freeborn Igbos. We reject Fulani domination in all ramifications!

Why is Falana speaking from both sides of his mouth? He should maintain a dignified stance.

This makes absolutely no sense. How can u expect the AGF to withdraw the case, just to test whether onnoghen will voluntarily step down No way! The case should be pursued to its logical conclusion
Onnoghen is a stubborn goat. If u give him chance, the first thing he will do is to quash the NJC petitions and secure perpetual injunction to prevent any investigation.

Yes. He is absolutely confused. He has the same agenda with PMB to get rid of Onnoghen by all means necessary but then he is more wary of doing it illegally more than his other gang members.

Onoghen nailed his own coffin when he admitted that he "forgot" he had those assets. He also decided to behave like a rascal by indefinitely postponing the NJC meeting.

Onoghen has already said he is guilty as accused so there is no pdp or apc thing here.

APC didn't ask him to stash dollars way beyond his pay grade, afterall, Osinbajo a fellow lawyer like him is worth over a billion naira n he didn't forget to declare.

If you don't have skeletons, nobody can witch-Hunt u. Lessons for us all.

If u feel it's a witch-Hunt, vote our APC in next two weeks time n start witch hunting all their members

That Falana is more dubious. He pretends to be neutral and for the rule of law while at the same time he fighting for the ultimate goal of the APC-The removal of Onnoggen.

A seasoned and well read lawyer who earned all his stripes speaks, dirty broke boys who can't even clean his shoes will argue and insult him all because of free data.

The internet is indeed a HUGE leveler.

Onnoghen is part of those people that have received monies from Ati'aku Al'Camerooni to destroy the zoo. People ask yourselves if these are mere coincidences.

1. Why is Titi Abubakar hardly seen with Ati'aku?

2. Why did Obasanjo say Ati'aku's origin is shadowy?

3. Why does Ati'aku have several choice properties in Cameroon?

4. Why did his wife tell us he does not need the Nigerian money?

5. Why did Biafra lose Bakassi to Cameroon when he was the VP?

Ask yourselves these and you would agree with me on the necessity for Ati'aku to remove his trousers and show us his right thigh!
