Festus Keyamo, the re-election campaign spokesman for President Muhammadu Buhari who seeks a second term in office, says the punishment the Nigerian leader prefers and wants to unleash on ballot box snatchers is constitutional.

Mr Buhari had on Monday promised to terminate the life of anyone who hijacks the ballot box as the rescheduled general election kick starts on Saturday.

The president’s threat has generated reactions to which a fact check by POLITICS TIMES proved him wrong as the country was still operating under a democratic regime with electoral laws to punish those caught in the act of thwarting the electoral wish of the people.

Even the electoral body conducting the election said the president’s preferred punishment is not applicable as the commission under its act has punishment spelt out for such malpractice.

For the Senior Advocate of Nigeria (SAN) the president’s preferred punishment on defaulters is constitutional.

The legal practitioner stated this during a Channels television programme: The Verdict. Senator Dino Melaye also featured representing the opposing camp.

Keyamo who did not cite any section of the law to back up his claim said ballot snatching can be likened to robbery as the two crimes has criminal relations and can be tried using either electoral or criminal law.

He argued that armed robbery is punishable by death, saying Buhari’s statement should be understood as a commitment to protect the majority against the violent minority, which ballot snatchers represent.

The lawyer said both Nigerian and international law provided for an exception that allows criminal to be killed extra-judicially.

“I will advise the president to make the statement again and again…so if you don’t want to die, don’t snatch ballots,” Keyamu said.

Opposing him is Mr Melaye who described the president’s punishment as an endorsement of jungle justice.

“The president does not have the power to pronounce death on anybody even a criminal. That is for the judge and the president is not a judge,” the Senator said.

Immediately our incoming President, H.E. Atiku Abubakar is sworn in, we will demand for a review of the process that made Mr Festus Kenyamo, Sagay, Femi Falana, etc, SANs. These guys are bringing so much shame and disgrace to the Law Profession. Something must be done about their
double-mouthed way of speaking and their reasoning.

These days, I think even Mr Ibu and Baba Suwe have more knowledge of the law and constitution than these guys

That SAN title will be revoked once the tyrant is removed from power. Malami too. Both of them are not worthy of it.

How this Keyamo of a guy who we all thought as a direct scion of Gani would have been d rallying point for human rights activism suddenly became inhumane and undemocratic still beats my imagination. I really respected Keyamo as a human rights crusader but cos of selfish aggrandizement has become a puppet to d govt and alongside his partner in crime Sagay have both turned d law upside down. The good thing is dat political patronage doesn't last forever and all these their efulefu interpretation will come to haunt them and their likes someday.

many rumors have started flying around that the election was postponed to pave way for rigging. These rumors are capable of discouraging some people from coming out to vote on the rescheduled dates!
Please even while we have our suspicions, let's not completely believe the rumors. These rumors should rather make us to be more vigilant and do more on intelligent information gathering to forestall any rigging by the evil men in power. Let's try and always be miles ahead of them.
Together we can change this evil government for good!

5 Billion Dollar MTN fine
Early in Buhari govt without even a policy direction in place and heavy economic uncertainty the Buhari govt in its bid to raise cheap funds will make a very bad mistake by fining telecoms success story MTN a mind boggling whooping 5 billion dollars for failing to properly register less than 1% of its subscribers a practice common with all 4 mobile Telcos in the country but surprisingly only MTN was singled out for this quite suspect fine which may industry observers have said is nothing short of a grandiose approach to executive extortion but that's as story for another day , the bottom line is that this poorly thought out fine triggered a megathrust of capital flight out of the country by many private sector players including the same same MTN who feared that same fate could befall them under the knee jerk Buhari govt and in less than 4 weeks over 80 billion dollars was spirited out of the Nigerian Govt under the nose of Buhari in one of the greatest mass capital flight ever recorded in a developing economy.
The Outcome : The capital flight triggered by the fine would put further strain on the economy once more and slow down any further new investments by such players , MTN will go further and cut it's support for thousands of small Nigerian Businesses and ideas citing lack of funds ( yours faithfully lost a lucrative advertising business my company ran regularly with MTN) MTN will drop many youth ambassadors it sponsored.

What other country on this planet can you go to a polling station, armed with machetes, guns and other weapons with the intention of snatching ballot boxes and expect not to be shot? I can't think of any.
