Supreme Court Dismisses Abraham's Case Against Akeredolu by Gennygolden(f): 1:53pm On Mar 05, 2019
The Supreme Court has struck out a suit instituted by Segun Abraham against Governor Oluwarotimi Akeredolu, SAN, challenging his emergence as the candidate of the All Progressives Congress (APC) for the November 2016 governorship election.

The Supreme Court on Tuesday struck out Abraham's case for lack of competence.

The court held in line with the provisions of the fourth alteration especially Section 285 (11) of the 1999 constitution as amended , that Abraham failed to file his case within the stipulated 14 days after the cause of action.

The court explained that Abraham approached the court 28 days after the primary election he was challenging instead of the stipulated 14days.

The Supreme Court heard the appeal filed by Governor Akeredolu, in which he challenged the competence of the suit filed by Dr. Olusegun Abraham against the result of the Governorship primary election held on 3rd September, 2016 which produced Akeredolu as the party's candidate.

The Federal High Court sitting in Abuja had ruled that it would hear the case to conclusion notwithstanding that the same was incompetent.

Against that decision, Arakunrin Akeredolu appealed to the Court of Appeal, Abuja which ruled that the appeal filed by Akeredolu should be deferred until the conclusion of the case by the Federal High Court, Abuja.

Dissatisfied with the decision Arakunrin appealed to the Supreme Court. After hearing counsel for the Governor, Chief Akin Olujinmi, SAN, counsel for Dr. Olusegun Abraham, Professor J.O. Amupitan, SAN and counsel for All Progressives Congress, Prince Lateef Fagbemi, SAN, the Supreme Court upheld the arguments of counsel to the Governor, Chief Akin Olujinmi, SAN and ruled that the suit filed by Dr. Abraham before the Federal High Court, Abuja was incompetent and the same was struck out.
