US Court Dismisses Biafra Suit Against Nigerian Government

Publish Date: Jul 26 2018 4:32PM

A District of Columbia (DC) Court in the United States (U.S.), has dismissed the suit filed by the Indigenous People of Biafra (IPOB) against the Federal Government and 15 others seeking millions of dollars compensation.

The group, through its plaintiff, Godson M. Nnaka and his lawyers, is also seeking payment of 40 per cent of the $550 million Abacha loot.

Respondents in the suit are the Chief of Army Staff, Lieutenant General Tukur Buratai, Director General of the State Security Service (SSS), Lawal Daura, former Inspector General of Police (IGP), Solomon Arase and his successor, Ibrahim Idris.

Others are governors of Abia and Anambra states, Okezie Ikpeazu and Willie Obiano.

IPOB had filed the case against the defendants in the U.S. court, alleging rights violation, torture and killing of its members, who were on peaceful protest at different times and locations between 2016 and 2017.

The trial judge, Dabney Friedrich, dismissed IPOB's case for lack of jurisdiction, saying officials of the Nigerian government enjoy foreign immunity.

The case was filed by counsel to IPOB, DC Attorneys, Fein & DelValle PLLC, while the Attorney General of the Federation (AGF), Abubakar Malami, retained the services of Anthony O. Egbase of (AOE) Law and Associates to represent Nigeria.

IPOB had alleged that the respondents conspired and agreed to kill Biafran civilians in order to crush Biafra and terrorise them.

According to them, government officials engaged in extra judicial killings of Biafrans, tortured and killed peaceful protesters during the Biafran Patriots Day parade on May 30, 2017.

Nigeria is an independent country.
Hence, the US can't directly interfere in its affairs.

I don't agree with this move. What's wrong with writing to the Prosecutor of the ICC attaching all the evidence, pursuant to the Rome Statute? This is obviously a violation of Article 6 of the Rome Statute. It has absolutely nothing to do with the US.

The Judge finished the so called "Land of the rising sun " with one sentence:

"The trial judge, Dabney Friedrich, dismissed IPOB's case for lack of jurisdiction, saying officials of the Nigerian government enjoy foreign immunity."

grin grin

Maybe all their international display of madness will stop now.

Before illiterate Zombies start creaming their pants, the matter was decided on a mere technicality of sovereign immunity. It was not a decision based on the merits of the case. So when the government officials lose their immunity after they leave office, the case can be reinstated. This is just a simple postponement.
