The standing order of 2015 in reference was a controversial order believed to have been forged and smuggled into records by DSP Ekweremadu who also was an officer in the 7th Senate.

There was no entry of record under the Leadership of Senator David Mark in 7th Senate that a legitimate standing order existed beside that of 2011.

So which Senate passed standing order of 2015? Not passed by 7th and not passed by 8th but yet it became the document used to conduct the ballot that elected Saraki and Ekweremadu.

It was forged. It has been in court ever since. It is an illegitimate procedure to use in conducting the leadership election. Set it aside and use what was officially passed and legitimized by 7th Senate....the order of 2011!

APC is very mischievious. They should have done a follow up on the issue since 2015....they left it hanging deliberately because they calculated that a ruling such as the one now given by this court will result in their favor and their endorsed candidate a walkover in victory.

Nobody is running to court. The court has oversight on laws. Legislature is where you make laws. So it is the court business to intervene, without any external body suggesting the need.

The judgment is clearly about the internal rules of the assembly which is inferior to the constitution therefore subject to judicial review.the judgment is binding on the nass bureaucracy not the lawmakers.

It's actually the opposite,they have the power to force the NASS to follow it's own rules and regulations; matter of fact, that's one of the primary roles of the court in a democracy. The point is the NASS made the rules on how to arrive a method with which to elect their presiding officers, in this case, that any method chosen ( secret or open ballot system) must be brought to the floor and voted on by a quorum of it's members. Well, according to the evidence before the judge, the last time that was done was for the 2011 method, the 2015 method was never voted on, hence a violation of NASS's own rules of selecting a method of election of presiding officers.

It's the same logic behind courts voiding political party's primary elections, substitution of candidates, if and when a party fails to follow it's own rules on conducting primary elections. So, the court is not telling the NASS what to do, but rather that what they have done wrt the 2015 election methodology, is in violation of their own rules hence invalid and a need to revert back to the 2011 methodology.
