It is only the background story to this question that can determine whichever answer that might follow o...

This is because there are three (if not four) parties involved in this:
-the man
-the wife
-the sperm donor
- the child
And the reaction or role played by each and everyone of them under whatsoever circumstance or their reactions all matters...

In Nigeria, there is no legal precedence YET for paternity fraud suits, it only just gained momentum in the developed world within the last 30years and I am glad they are creating laws that also put the interests of men over malicious women.

I have heard of the case of a man in California who had been paying child support to his ex-wife for years, only to discover after DNA testing that the children were never his.
He sued her, and although the lower courts ruled against him (California is largely pro-women), by the time he got to the court of appeal, the decision of the lower courts was rescinded and he was awarded damages in addition to ending all child support payments to his ex.

Nigeria will get there.

Best thing now is for men to always have DNA testing done on their children immediately after they are born, don't let love and sweet pùnani block common sense.
Any woman that will vex because of this probably has something to be afraid of.

Anyone can sue anyone.I’m sure you can sue in Nigeria.

Whether you win or not will then depend on the circumstances of the case. (In Nigeria, he might most likely win).

Also note that there may not be any incentive for the man to sue unless his wife is rich and can compensate him financially. Otherwise what would be the point of the court case, the attorney fees, and trips to and fro the courthouse? if he’s only going to end up as he would without the court case.

Because once he proves the child is not his via a DNA test, he can just file for a divorce and he doesn’t have to pay any child support. What’s suing the wife going to do for him? Like I said, unless she has money to give him there’s no incentive for that.

Are you in the real world? Do you know how many men and women would be in jail for having kids with men and women who aren’t their husbands and wives?

Anyhow people don’t go to jail for non-criminal stuff

You can sue her for fraud, I think.

But what's the point? The deed is done. The child is here. No amount of lawsuit will undo the conception...unless the woman is rich and you want to sue her for at least half of what she owns.

1. If she was pregnant at the time of the wedding and your marriage is less than a year, then you can seek an annulment. In the eyes of the law/state that marriage never existed.

2. You can sue for a divorce, parental fraud AKA infidelity is grounds for a divorce, you can also ask the court to relieve you of all parental obligation.

You people have been going on about fathering other men's children for ages now.

So, with all your superior spying and monitoring skills, you're still embarrassingly unable to figure out how to stop your women cheating on you?

Because you do boast a lot about how you have remote viewing of other people yet you can't remote view your own selves and are always asking cyberspace what to do about your cheating girlfriends or wives.
