ABUJA, Dec 08, (THEWILL) – A Federal High Court, Abuja Division today threw out a suit filed by Chairman of Daar Communications Plc and former Director General of the Presidential Campaign Organisation of General Ibrahim Babadamasi Babangida, Chief Raymond Dokpesi against the State Security Service (SSS) challenging his arrest and detention following its investigations into the Independence Day anniversary bomb blasts in Abuja.

Justice Abdul Kafarati dismissed the case following an application to withdraw the suit by Dokpesi’s counsel, Chief Kanu Godwin Agabi.

“The law is trite that once issues have been joined by parties to an action, any motion for discontinuance of the suit attracts an outright dismissal of the suit. I therefore urge your lordship to dismiss this suit, ” Alex Izinyon, counsel to the SSS submitted.

Based on Izinyon’s submission, Justice Kafarati agreed and thereafter dismissed Dokpesi’s action.

Chief Dokpesi had filed a suit asking the court to declare his arrest and detention unlawful.

The SSS had arrested and briefly detained Chief Dokpesi following revelations that he allegedly had contact with one or more of the alleged bombers four days before the blasts. The SSS alleged that Dokpesi passed on N4, 000, 000 (four million naira) to one of the suspects in SSS custody but Dokpesi has maintained that he has no hangs in the bombings.
