A Nigerian company, Crompton Resources Limited has dragged a foreign owned companies Dominos’ Pizza and Cold Stone Ice-Cream to Court over N34 Million Debt.
Crompton Resources Limited, a company duly registered and engaged in the business of building construction and allied matters with registered office address in Lagos was contracted by Eat N Go Ltd (owners/master franchise of Dominos’ Pizza, Cold Stone Creamery) in 2018 to execute the construction of some of its outlets in Lagos.

In the court papers filed by the Claimant’s Lawyers against Eat N Go Ltd at the Lagos State High court, Some of the outlets constructed, equipped and furnished by Crompton Resources Limited for Eat N Go Ltd includes outlets at 434, Old Ojo road, Satelite town Lagos, 1 Ologolo village road, Ologolo, Jakande, Lagos, and Iju Ishaga, Lagos state.

The Court papers further revealed that upon completion of the oulets, Eat N Go Ltd refused to pay the contract sum balance of N34, 000, 000 (Thirty Four Million Naira Only).
It was gathered that the total contract sum used for the construction of Dominos’ Pizza/Cold Stone Creamery outlets was a loan facility obtained by Crompton Resources Limited with the belief that upon completion of the outlets, the loan sum will be liquidated.

The court papers further revealed that the Claimant as a result suffered huge loss and incurred great liabilities as a result of the persistent refusal and neglect by owners of Coldstone icecream to liquidate the sum of N34, 000, 000 (Thirty Four Million Naira Only) being oustanding balance of the total contract sum despite being served with several demand letters from Crompton Resources Ltd lawyers.

The Court papers went further to show that in a bid to further frustrate Crompton Resources Ltd, owners of coldstone ice-cream wrote through their lawyers acknowledging owing Crompton Resources Ltd but requested that the matter be withdrawn from court before they can proceed to settle amicably.

The matter came up on the 18th of February, 2020 but could not proceed as the court did not sit. It was further adjourned to 3rd March, 2020.

The Claimant condemned the conduct of Eat N Go Ltd as not just reprehensible but unbecoming of a company owned, controlled and managed by foreigners.

How else would a foreign company come into the country to hire a local contractor, then proceed to owe for service rendered?
What audacity!!!

Someone must have taught them how to stretch their luck through the courts of our land.
