The Supreme Court, on Tuesday, declined to restore Emeka Ihedioha of the Peoples Democratic Party, PDP, as the Governor of Imo State.

The apex court, in a decision by a seven-man panel of Justices led by the Chief Justice of Nigeria, CJN, Justice Tanko Muhammad, reinstated the judgement it gave on January 14, which declared Hope Uzodinma of the All Progressive Congress, APC, as the validly elected governor of Imo state.

In the lead verdict that was delivered by Justice Olukayode Ariwoola, the apex court, held that Ihedioha’s application to set-aside the judgement that removed him from office lacked merit.

It held that the application was an invitation for the Supreme Court to sit on appeal over its own final judgement.

Though it dismissed the application, the apex court refused to award cost against the Applicants.

However, a member of the apex court panel, Justice Centus Chima Nweze, disagreed with the lead verdict and gave a dissenting opinion that allowed Ihedioha’s application.

Nweze said he was satisfied that the judgement that declared Uzodinma winner was entered in error.

He held that the apex court has a duty to in the interest of justice, set-aside its decision that was given in error.

Leave him oooo....The SC did the write thing by ending litigations and better still by refusing to place fines.

I only query the fact they should have set records straight.
The issue of constitutional spread is dead, and your votes can exceed number of accredited voters.

These politicians and their SANs will.go back to their drawing-tables and fix the lacuna themselves.

In truth, it's a pyrrhic victory. No costs, no calling out lawyers for bringing review and even a dissent!! That's the important thing. We all understand the timidity of our judges. They could have done better but I'm happy they didn't do worse.

Neither did Hope, infact, according 2 d supreme Court"s earlier ruling,Uche Nwosu is d valid APC candidate I'd last gubernatorial.

Section 140 of the constitution recommends rerun when a candidate is disqualified but the SC relied on the electoral act 2010 updated which recognises joint ticket and forfeiture of the candidacy.....It is still in order and will serve as a lesson for parties that take things for granted.

Just as predicted.....although SC should have admitted the errors before dismissing the case finally. But all in all, SC can't change it's judgement. QED.

Agbin cost us that victory. He was re-litigating instead of following the original prayers which was predicated on the enforcement of SC earlier judgment that declared Nwosu as the rightful candidate of APC.

Even elementary law students know that the SC can't sit on appeal over their judgement, bringing election related matter is purely re-litigation.

What cost us Abia in 2015 was a silly mistake by the lead counsel, Olujimi. We won at the Appeal but couldn't at the Supreme Court.

That loss still dey pain me till date.

Sometimes I wonder what even makes this guys SANs. Imagine Wole babbling in the SC in Lyon vs Diri. The court should have imposed higher fines
