Ihedioha's guber review application dismissed, Justice Nweze dissents by fergie001: 3:35pm On Mar 03, 2020
The Supreme Court, on Tuesday, declined to restore Emeka Ihedioha of the Peoples Democratic Party, PDP, as the Governor of Imo State.

The apex court, in a decision by a seven-man panel of Justices led by the Chief Justice of Nigeria, CJN, Justice Tanko Muhammad, reinstated the judgement it gave on January 14, which declared Hope Uzodinma of the All Progressive Congress, APC, as the validly elected governor of Imo state.

In the lead verdict that was delivered by Justice Olukayode Ariwoola, the apex court, held that Ihedioha’s application to set-aside the judgement that removed him from office lacked merit.

It held that the application was an invitation for the Supreme Court to sit on appeal over its own final judgement.

Though it dismissed the application, the apex court refused to award cost against the Applicants.

However, a member of the apex court panel, Justice Centus Chima Nweze, disagreed with the lead verdict and gave a dissenting opinion that allowed Ihedioha’s application.

Nweze said he was satisfied that the judgement that declared Uzodinma winner was entered in error.

He held that the apex court has a duty to in the interest of justice, set-aside its decision that was given in error.

Dear Ihedioha, you can appeal to God if you’re not satisfied. You didn’t win the election in the first place and your initial declaration by INEC was a gross abuse of the constitution. Whatever money is left with you, go and be managing it till 2023 when you will have another chance to try your luck again. For now, it’s GOVERNOR HOPE UZODINMA till 2023 tongue.

This goes to show that the supreme court saw that they made mistake in the judgement but there was no way they could admit it so as not to set a bad precedence.

Just as predicted.....although SC should have admitted the errors before dismissing the case finally. But all in all, SC can't change it's judgement. QED.

The major reason he gave for dissenting was one of the new grounds Ihedioha's lawyer Agabi added to the new petition he filed before withdrawing the old one. Besides his wife is a is very close to Gov Ugwuanyi

Supreme Court knows that they made an error but as we have it. They don't want to give room for countless litigation.

Tanko and his team should bow their heads in shame not only because of their errors but because they failed to explain to the legal world the meaning of their actions.
What a shame.

PDP should take it in good faith.

That's a reckless accusation.

Onnoghen as SC judge twice dissented against the PDP's victory against Buhari, so you mean he contributed to the application.

Bulkachuwa's husband is a Senator in the APC.

Adamu Augie's late husband was a Senator in Buhari's party at the time, ANPP.

Odili was a member of the panel that upheld Okororcha's election in 2011.

Allow laymen like us make this kind of accusations please, not you guys in the profession.

For the Records, Centus Nweze's wife is not a card-carrying member of any party, she is a judge at the Enugu State High Court.

a bad precedence is already set. returning officers now have a choice of declaring a candidate winner without meeting geographical spread.

On his Twitter page, he was retweeting and accusing Odili (on Bayelsa)....But now, he is speaking from different parts of his mouth.

Leave him oooo....The SC did the right thing by ending litigations and better still by refusing to place fines.

I only query the fact they should have set records straight.
The issue of constitutional spread is dead, and your votes can exceed number of accredited voters.

These politicians and their SANs will go back to their drawing-tables and fix the lacuna themselves.
