A twitter user identified as Barr. Kutuh, has taken his twitter account to unveil the fact that forcefully sleeping with your wife is not rape according to the Nigerian law, CH Reports

Forcefully sleeping with your wife against her will is not rape, because A man can not rape his own wife under the Nigerian law.

The laws governing rape in Nigeria are the Criminal Code and the Penal Code. The Criminal Code is applicable to Southern Nigeria and the Penal Code is applicable to Northern Nigeria.

The Penal Code, states under Section 282, that man is said to commit rape who, SAVE WHERE HE HAS SEXUAL INTERCOURSE WITH HIS WIFE, has sexual intercourse with a woman against her will and without consent...etc

The Criminal Code states that Any person who has unlawful carnal knowledge of a woman or girl, without her consent, or with her consent, if the consent is obtained by force or by means of threat or intimidation of any kind, or by fear of harm, or by means of false and fraudulent representation as to the nature of the act, or, in the case of a married woman, by personating her husband, is guilty of an offence which is called rape.

The notion that a husband cannot be guilty of rape upon his wife is predicated on the then generally accepted view of the common law. It was based on a theory articulated by Mathew Hale, Chief Justice in England in the 18th century who wrote in 1736 that: the husband cannot be guilty of a rape committed by himself upon his lawful wife, for by their mutual matrimonial consent and contract, the wife hath given up herself in this kind unto her husband which she cannot retract.

In other words, marital rape is not an offence in Nigeria. A husband cannot rape his wife. It is assumed that the wife gives implied general consent to sexual intercourse with her husband upon entering the marriage contract.

My Opinion: Nigeria need to amend its laws to suit the present state.

Marital sex without the other party's consent should be tagged as rape. PERIOD!!!!

Nigeria need to amend the laws like seriously!!!!!!

It is sad that women can't be accused of rape in Nigeria.

You say yes. She says no. You can't claim consent by any stretch of the imagination.

That's the type of law that's written by people who believe it's normal to marry.girls when they are underage.

Forceful sex is rape but if my wife denies me sex twice consecutively without a cogent reason she is leaving my house for life. Matter settlers can't save her

Op (@ Citizenshelm) the headline is so sensitive and degrading, it would definitely pitch a regular title readers (those who don't go or read beyond the headline) against the writers' point of view... please modify the heading

Secondly, Nigerian laws that were handed to us by the colonialist are in greater sections out-of-date, or let me say behind modernization, get a copy of our Constitution, you'll know part of its section lack the present day taste..... The Laws are weak and confusing on sexual abuse in matrimonial home...

You cannot force yourself on your wife to have sex. That is statutary rape and the offender is liable to imprisonment as rape is a felony. A any forced sex on girl, lady or legal wife is 'RAPE' no matter how you see it.

And that same law is pushing some women to stab their husband, nobody wins. There is need for communication between spouses because it is not just about physical release.

I don’t support rape in any form oh but there’s nothing like marital rape in the Nigerian constitution.
Try going to the police station and tell them that your husband raped you and see their response.

Most Nigerian men believe once they pay bride price they automatically own the woman’s body and as such can’t be denied sex. The police and constitution seem to agree with such beliefs.

Nb; I don’t support rape

Normally, the person you willingly consented to marry should have unrestricted access to conjugation with reason and that is both ways. The law maybe draconian, but it is there.
Children shouldn’t rush into marriage and then try to cherry pick. And those that aren’t married, no pressure. Marriage is a lot of work. Don’t go and come and be crying rape.
You can sue for sexual abuse though, and if he took anal without your consent you can sue for sodomy.
