Client Terminates Contract,cos We Observed Lockdown. How Can We Seek Redress? by Blessedkingg: 8:20pm On Jun 12, 2020
We have a client,who we are working for.
We submitted our estimates and sample materials for the job amongst other contractors...Our sample was chosen and approved. We got the job in january of this year,just before the lockdown we had attained 54% completion..We went home during the lockdown,and she kept calling and ordered us back to site,well We let her know we were observing government lockdown,she was furious and threatened to deal with us.
Two days after the lockdow was lifted,we rushed to the site and commenced work at full throttle,and achieved 75% completion.
We reached out to her to pay the next tranchr of funds. She started dribbling us. Next thing she terminates the contract with a letter from her lawyet,citing that we didnt deliver within the 8weeks agreed on the contract agreement documents.
She was supposed to pay us 2.4M at 70%/completion,now she hasnt paid anything instead she is citing that we breached the delivery date...was it our fault that the Government lock down affected our delivery date? How can we seek redress? She still owes us 6M naira,and the work is essentially finished,how can we get her to Pay us,or seek redress.? Pls useful advice would be appreciated..

You can invoke the doctrine of Force Majuere. Just get a Lawyer. Good luck.

Your best bet is to get a very good lawyer, show and explain to him or her what the contract states, he or she will definitely know how to help from there.

The lockdown really caused more harm than good economically.

Force Majeure is your way out of this, but na court ooo. So prepare to pay some legal fees and all.

Yeah! We wrote them a response and they fixed a meeting for today.

We are at the meeting site now. Op is not here, he couldn't make it. He has other pressing business to attend to.

We will be discussing settlement today. But if for any reason settlement fails, we will role out our war chest and engage by Monday.

We are fully ready and waiting. What was done to him is an injustice of no equal measure.

But like I said at the begining, we will get to the end of it.

Op was doing a fantastic job on the site. Just that these persons felt they could cheat a good man out of his sweat.

We need to learn to respect the sanctity of contract in Nigeria. We just have to, if we must grow as a nation.
