The ruling All Progressives Congress APC said it is not aware of the defection of the Edo state Governor, Mr Godwin Obaseki from its party. National Publicity Secretary of the Party, Mallam Lanre Issa-Onilu in a reaction to media enquiries regarding the defection said the party cannot comment on media reports suggesting that the governor has left the APC. “The party has no record of the reported defection of Governor Godwin Obaseki from the Progressive party. We cannot comment at this moment on media reports suggesting the Edo governor or anyone else has left our great party”, he said. The governor who was last week disqualified from participating in the June 22 Governorship Primary Election of the party in Edo state was reported to have announced his resignation of membership of the party on Tuesday. Obaseki should not make the mistake of forgetting to write the Party before he declare for another party.
Also we want to see if all his cabinet members will follow him.

How will APC be aware? They are never aware of anything!!! PDP is corrupt but APC is a total SCAM!!

What I think may happen is Obaseki submitting his resignation letter to his faction of the APC, which faction cannot ordinarily convey it to the NWC, since it's not recognized.

Could this limbo — if it comes to that — be a legal albatross on Obaseki's neck as he joins another party?

Or Obaseki could simply swallow his pride, submit his resignation letter to the faction recognized by their NWC, and be free of potential legal obstacles and landmines in that regard. His call.

but he has been disqualified. He can't participate in the primary on the 22nd

And do you think Obaseki will do that? Knowing fully well how he suspended the Party National Chairman through the ward excos... If he writes the NWC then that shows He knows the rule and show not to follow it.

Can't he address his resignation letter to his ward chairman. I think at that level, he is covered. Just my thought though

You are correct.
Of course he can do just that and that will be all regarding his membership resignation with APC.

He was disqualify from participating in the APC primary.... So technically he can still participate in other party's primary.

Registration is at the ward level. Resignation should also be at the ward level. There are no factions at the ward level.

he didn't participate in the primary he was screened out prior to the primary election.

Uche Nwosu's case is different. He defected to AA when he lost the APC primary but in the case of Obaeki he didn't participate in the primary election at all

Whoa, this is a huge reveal. I won't be surprised if the Supreme Court at some point rules that steps such as purchasing form and participating in a screening process are all part and parcel of the party primary process; but that !ay be pushing it. Lawyers will definitely bring it up.
