Eight injured, 20 houses set ablaze Seriki Adinoyi At least five persons have been killed and eight severely injured in fresh attacks allegedly perpetrated by armed Fulani herders in Jebbu-Miango village, in Bassa Local Government Area of Plateau State. Houses were equally razed in the attacks which took place on Thursday night. This is even as Governor Simon Lalong denied ceding any portion of Plateau land for cattle colony, adding that he did not contemplate cattle colony, neither did he have it in his imagination. Confirming the attack, the state’s Police Public Relation Officer, Tyopev Terna put the death figure at three. He said: “Yesterday (Friday) at about 1900hrs, the Police Division in Bassa Local Government Area received a distress call that Jebbu-Miango in Bassa was under attack. The Division immediately informed the Command and we mobilised to the place. “While we were close to the village, the armed men suspected to be Fulani herdsman sighted us and took to their heels. “Three people were killed and burnt by the armed men: One Danlami Gomaster of Kwall District and one Emmanuel Audu of Jebbu-Miango were identified while the last person is yet to be identified. Eight other persons sustained various degrees of gunshot injuries and were taken to Enos Hospital in Bassa for treatment. 20 housing units were also set ablaze.” But disagreeing with the death figure, President of Irigwe Development Association (IDA), Mr. Sunday Abdu said aside from the three that were killed and set ablaze along the way in the car they boarded from a Jos market to the village, two others were killed in the village by the same herders. He lamented that in spite of the repeated alarm raised about imminent attack by Fulani herders, the security agents did not take proactive measures to protect the people. Also condemning the attack on the people, the Publicity Secretary of IDA, Malakai Gulu said the gunmen opened fire on the vehicle conveying travelers from Jos, killing the three on board before setting their remains on fire in the car. He said the attackers extended the rage into nearby villages, resulting in more casualties and burning of houses. This becomes the third attack by herdsmen on Miango villages in one week, resulting in over ten deaths, with several others sustaining various degree of injuries. Security agents have linked the attacks to reprisals by the Fulani who had last week reported loss of some cattle to suspected Irigwe youths. Meanwhile, after a second thought, Lalong, yesterday rejected the proposal by the Federal Government for cattle colonies. The governor also described as “false, malicious and highly mischievous”, the reports in the social media that he had carved out parts of Riyom, Barkin Ladi and Bokkos local government areas for the creation of cattle colonies. In a press statement by his Special Adviser on Media and Publicity, Dan Majang, Lalong advised all peace-loving citizens of Plateau State to “discountenance such mischievous information” and gravitate towards issues of unity, rather than those that divide them. “Governor Simon Bako Lalong has and does not contemplate such action and he further calls on all good citizens of Plateau to bury such imagination of these elements bent on throwing the state into confusion. • Orders Abaribe, 2 others to bring IPOB leader for trial Godwin Tsa, Abuja The controversy surrounding the disappearance of Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra, IPOB, remains unresolved as a Federal High Court in Abuja, on Friday, declined to order the Chief of Army Staff, Lt.-Gen. Tukur Buratai, to produce the ‘missing’ pro-Biafra agitator. The court, in a ruling that was delivered by Justice Binta Nyako, dismissed an application that was filed by a team of lawyers representing the IPOB leader, which prayed the court to compel Buratai to produce their client, either dead or alive. The lawyers, led by Mr. Ifeanyi Ejiofor, told the court that they have not seen or heard from their client since September 14, 2017, when the Nigeria Army invaded his house “on a murderous raid, where life and mortar bullets were fired on unarmed and defenceless populace, leaving 28 persons dead and abducting many”. Pursuant to section 40 of the Federal High Court Act, F12, LFN 2005 and section 6(6) (1) (4) of the 1999 constitution, as amended, Kanu’s lawyers applied for “an order of Habeas Corpus ad subjiciendum, commanding the Respondent (Buratai), to produce the Applicant in Court”. However, in a counter-affidavit he filed, Buratai told the court that Kanu was never in custody of the Nigeria Army. He maintained that contrary to claims in the suit, soldiers who were deployed to the South-East for ‘Operation Python Dance II, did not have any contact whatsoever with Kanu on September 12 or 14, or anytime thereafter as alleged. The Chief of Army Staff told the court that the Army did not at any time arrest or took Kanu into custody during the period the military operation lasted, even as he denied allegation that soldiers invaded the IPOB leader’s house in Afara-Ukwu Ibeku, Umuahia, Abia State. A colonel attached to the Chief of Army’s office at the Army Headquarters, Abuja, Col. A.A Yusuf, who deposed to the counter-affidavit on behalf of Buratai, said the alleged invasion of Kanu’s house was totally false. The Army boss told the court that his men only chased a truck he said was laden with arms and explosives of different kinds, into a compound he said was later discovered to belong to Kanu and his father. Ruling on the matter on Friday, Justice Nyako held that no evidence was placed before the court to prove that Kanu was in Army custody, adding that Ejiofor failed to convince the court that Kanu was seen with soldiers at any time. She said “the doctrine of last seen”, which the applicant relied upon, even though applicable in murder cases, has no statutory backing. Besides, the Judge noted that Kanu was listed in the suit as the main applicant. Justice Nyako said she was surprised that someone that was said to be missing was the one seeking reliefs from the court, adding that the lawyers ought to have rather commenced the action “in the name of applicant”. She further held that affidavits Ejiofor’s team filed before the court contained criminal allegations against the Nigeria Army that must be proved beyond reasonable doubt. “Has the applicant placed enough evidence to show that the respondent was the last to see the applicant? Was there any evidence that he was last seen with even one soldier? The onus of proof will not shift from the applicant to the respondent except the applicant is able to prove that the respondent last saw him. This they have failed to do. This application fails and it is hereby dismissed. Be ready for your case”, the Judge held. Immediately the ruling was delivered, Ejiofor demanded to know from the court what the next line of action would be in respect of Kanu’s pending trial, since his whereabouts has remained unknown. Replying Ejiofor, Justice Nyako said: “As far as I am concerned, the applicant is on bail. Was he not released on bail based on an undertaking by sureties? “The sureties guaranteed to produce the applicant in court for his trial, so three of them should produce him. They made an undertaking and deposed to the fact that they will produce him to stand trial. If there is any reason they cannot produce him, they should tell me on that date”, the Judge added. The court had earlier fixed February 20 for continuation of Kanu’s trial. The IPOB leader is facing a five-count treasonable felony charge the Federal Government preferred against him and four other pro-Biafra agitators; Chidiebere Onwudiwe, Benjamin Madubugwu, David Nwawuisi and Bright Chimezie. Already, Senator Enyinnaya Abaribe who was one of the three persons that stood surety for the IPOB leader has applied to be discharged by the court, insisting that he lacks the capacity to produce the defendant for continuation of his trial. • Urge FG to form multi-party committee on implementation Emmanuel Addeh in Yenagoa Bayelsa State Governor, Seriake Dickson, has commended the ruling All Progressive Congress APC, on its far reaching recommendations on the issue of the proposed restructuring of the country, adding that it had further strengthened the agitations for true federalism and resource control in the Niger Delta. Also, the Ijaw Youth Council (IYC) worldwide, yesterday demanded expeditious action on the Governor Nasir el-Rufai report on restructuring presented to the leadership of the All Progressives Congress (APC) on Thursday. While calling on the APC to be sincere with the implementation of the recommendations, Dickson said restructuring Nigeria would calm frayed nerves and strengthen the nation’s unity. However, the Governor called on the leadership of the APC to ensure implementation of the recommendations of its committee on restructuring before the conduct of the 2019 General elections. According to him, implementing the report before 2019 general elections was the true test of the sincerity of the APC on the issue of the recommendations. The Special Adviser to the Governor on Media Relations, Mr. Fidelis Soriwei, said the Governor made the comment in an interview with journalists on the recommendations of the APC’s Committee on Restructuring led by Governor Nasir El Rufai of Kaduna State in Abuja on Friday. The El Rufai Committee had recommended state ownership of onshore mineral resources including oil, state control of police, prisons among others while presenting its report to the leadership of the APC on Thursday. Dickson said that he had to commend the APC for the recommendations on restructuring which he said came from an unexpected quarters some of whose leaders had opposed the calls to restructure the country. The Governor said that what the APC committee did in its recommendations were the most fundamental of all the approaches to the burning issue of restructuring in the best interest of the country. He stressed that as a politician driven by conviction, he had to commend the APC on its bold recommendations on restructuring because it was right and worthy of appreciation. He said, “This development came from an unexpected quarters in a matter that is dear to us; the subject matter of restructuring to address the inequalities in our country. Yesterday, El Rufai, who chairs the APC Committee, submitted the report; While it is true that we are dealing with a proposal, this is coming from an unexpected quarters, and in the light of the opposition to structuring from some leaders, I thought that what the APC did was unexpected. “Let me start by commending the committee and the leadership of that party for making what I will call the most fundamental proposal dealing with the issue of restructuring. This is very refreshing, and for me, when I see what is right, I commend it; when I see what is in the best interest of our country, I commend it because my politics is driven by conviction, not convenience. “With the kind of proposals that they have done, I thought I should appreciate their patriotism and commitment to building an equitable and prosperous Nigeria”. Dickson further called for the establishment of a multiparty committee to work out the final details for the executive arm to sponsor a bill to the National Assembly. He stressed that there was need to mobilise national consensus to engage the National Assembly in order to ensure the implementation of the core raised in the report before 2019 general elections. “I want to say that at this time, if we are all sincere about the injustices, and inequities, then I call for a multiparty committee to deal with the final details of the issues, the issue of the police, the judiciary, the control of land. We need a multi-party committee to discuss and agree and work on draft legislation bills that will be jointly sponsored at the NAS. “ALL of us need to mobilise national consensus to engage the National Assembly. So that we can drive all these issues, before the next election. That is the test of sincerity”, he said. . On the same report, the IYC maintained that it was not enough to submit the report and allow it gather dust, noting that the challenge in the country was in the implementation of such reports and not necessarily in the documentation. “Ijaw Youth Council (IYC) worldwide states that while the APC committee on restructuring recommendation on devolution of power including empowering states to have legislative control over mining and oil minerals is a welcome development, the APC-led federal government should go further to take immediate steps to implement the recommendation. “It is not enough for the APC committee on restructuring to recommend for some level of resource control by the states; since the APC is in government at the centre and majority of the states. “It should take the further steps to ensure immediate implementation of the recommendations, especially that on control of mines and oil minerals by states of the federation which has been a key demand of the Niger Delta people”, the group noted. Factional President of the IYC, Mr. Eric Omare, a lawyer, in a statement in Yenagoa, argued that it was only when the recommendations of the committee were implemented that Nigerians and especially Niger Deltans would take the APC position on restructuring seriously. He recalled that the APC had promised restructuring prior to the 2015 elections, only to deny knowledge of the true meaning of the concept after winning the general elections. He added: “hence, for the APC to be taken seriously on the issue of restructuring, the IYC calls on the APC led federal government to immediately initiate the process of amending the relevant provisions of the 1999 Constitution, the Petroleum Act. “The Land Use Act, the Minerals and Mining Act, the Petroleum Profit Tax Act and other relevant laws as recommended by the committee to bring the recommendations into reality”. IYC, he said, strongly believed that if the APC had the political will, this could be easily done because the party has majority both at the National Assembly and majority of the state houses of assembly to effect immediate amendment of the constitution and relevant laws. “Anything short of immediate legislative action to implement the recommendations especially on resource control would be regarded as mere political rhetoric to get the support of Nigerians in the 2019 elections”, the youth group said. http://www.mcebisco.com.ng/2018/01/bayelsa-governor-iyc-hail-apc.html

Police Kick As Evans Files N200m Suit Over Seized Trucks Suspected millionaire kidnapper, Chukwudumeme Onwuamadike (alias Evans), has urged the Federal High Court in Lagos to order the release of his seized 25 Mack trucks. Through his lawyer Olukoya Ogungbeje, Evans said the trucks were seized without a court order. The lawyer said the police forcefully confiscated the trucks from Evans last June 15 without any court order. But, the police have urged the court to dismiss the suit as the trucks were proceeds of crime and were exhibits. Ogungbeje wants the court to award N200 million as general and exemplary damages against the police for the alleged violation of Evans’ rights under sections 36, 43, and 44 of the 1999 Constitution. But, in a counter-affidavit, the deponent Inspector Haruna Idowu, said he was on the team that investigated Evans’ case. He said the suspect acquired 11 trucks with proceeds of crime, adding that 10 of them were recovered by the police. He said the trucks were listed as exhibits in the criminal charges filed against Evans at the Lagos State High Court. “The applicant is the notorious and most dreaded armed robber and kidnapper known as Evans, who defiled police arrest for over 10 years and who had terrorised many states with his various gang members. “The applicant has no other source of livelihood except armed robbery and kidnapping as so many arms and ammunition were recovered from the applicant during his arrest. “The applicant had purchased various properties with proceeds of armed robbery and kidnapping. “The applicant purchased 11 trucks with proceeds of crime. The police recovered 10 in Lagos while they were not able to tow the remaining one from Anambra State to Lagos due to the fact that the applicant’s brother-in-law, Mr. Okwuchukwu Obiechina, and his wife had tampered with the brain box of the truck in a bid to pervert the course of justice. “The trucks recovered are proceeds of crime which are preserved and kept as exhibits to be tendered in the ongoing criminal prosecution of the application at the High Court of Lagos State,” Idowu said. The Alliance for New Nigeria, ANN, has said the statement by former President Olusegun Obasanjo on President Buhari is a welcome development. The party said Nigerians would have still left their trusts in the hands of the All Progressives Congress, APC, and the Peoples Democratic Party, PDP, in 2019, if not for the Tuesday’s intervention of Obasanjo. ANN noted that the two leading political parties would lead Nigeria to nowhere. According to the newly registered political party, Obasabjo’s statement was a true reflection of the state of the polity. Obasanjo had on Tuesday advised President Buhari not to bother himself seeking re-election, citing several reasons. Senator Dino Melaye has revealed that the Nigerian National Petroleum Corporation, NNPC is operating an illegal dollar account with Keystone Bank containing a sum of $137 million. Melaye, who is the chairman of the Senate committee on FCT made the allegation on Tuesday. He raised a point of order saying that Brass LNG Ltd., Joint Venture Company(JVC) account was domiciled in Keystone bank instead of the Central bank of Nigeria, CBN as required by Law. He said; “While some individuals and government appointees will continue to steal, we have decided to continue to expose corruption in public life. This morning, I call the attention of the Nigerian Senate to a suspected, colossal, monumental corruption in NNPC. A company was registered with the name ‘Brass LNG Limited’ with the Federal Government having controlling shares. We have some Italians, Belgians, and French as shareholders, with the Federal Government with a controlling share of about 50 percent. It is a known fact that once you have a joint venture, the account of such joint venture will be domiciled with the Central Bank of Nigeria. But in this case, that was not what happened. In private, the account was opened with Keystone Bank; this account has no BVN and there has been periodic withdrawals. The last withdrawal from the account was to the tune of $4m.
