The Petitioner has forgotten that the NEC, the highest organ of the party has ratified every action taken by the NWC, even if taken in error. The NEC ratification is final on party primary which is internal affairs of the Party.

Obaseki agents should think of another thing. I think they need to think more of the impending revelation of how Obaseki gained admission into UI with just 3 credits without English and Maths. The fake GCE results he used will shock all of you.

U don't need to go to law to know that any court of competence jurisdiction ruling supercedes any political party decison

A very strong issue has been raised. I wonder why APC is never able to have some checks on their members.

If the courts impartially look at this case, APC may lose.
This and more should be expected as many PDP moles in the APC will want to play their double standard. For a lawyer it’s amazing to argue that the actions of the then national chairman is void forgetting that there was also an appeal courts ruling for a stay of the order of the high court pending the determination of appeal before it.

I saw this coming, I was wondering why PDP didn't go to court, as regarding the illegal APC exco that conducted Edo APC govenrship primary.
I think the game plan is to wait for 60 days before the election, and in few days before the election the court will claim in the eye of the APC has no candidate in Edo state

I'm surprised nobody thought of this ever since.
Shebi the outcome of their extra ordinary session is to suspend and withdraw all court cases. This was envisaged. The said APC member is either being sponsored by Obaseki or he just wants to be settled as well.

Two things may look alike but can not be compared. Go and get the real story of what happened in Zamfara.

A party NEC NEC decision can be overturned by any court, and has been done several times in the Nigeria political space, u guys should stop misleading people that a court can't overturn a political party NEC decision.
U don't need to go to law school to understand the law of the land is the guiding principle for any adjudication of political party affairs

“A declaration that in view of the judgment of the Nigerian Court of Appeal in Appeal No: CA/A/188/2020 delivered on the 16th day of June 2020, affirming as valid the suspension of the 2nd Defendant on the 2nd day of November 2019, all the decisions taken by the 2nd Defendant as the National Chairman of the 1st Defendant (during the subsistence of his suspension) is invalid, null and void and of no legal consequence.

The arguement is every action taken by the Oshiomole backed faction is null and void, he is not just talking about Edo Edo Governorship election, and the only court recognized NEC at that time was the Giadom court backed NEC, thus any action taken by Oshiomole backed NEC become null and void, the court doesn't give a fucking damn about APC NEC ratification if it wasn't the court recognized one at that time,


The question you ask u self which court ruling recognized the Ajimobi NEC faction, and where are the court documents to back the ruling

The whole world saw both the Appel court and high court ruling that gave Giaďom the power to act as acting chairman after Oshiomole Suspension

Zamfara case is very different. INEC disqulaified APC based on the fact that the party did not conduct a valid primary. The court at different levels simply affirmed the decision of INEC. In the case of Edo, a valid primary monitored by INEC was conducted. What Obaseki's people are saying is that the chaiman having been suspended does not have the powers to constitute the screening and primary election committee. Their argument makes no sense because the court of appeal ordered a stay of execution of the high court judgement. The stay of execution is a valid court order empowering Oshiomole to function as APC chairman. The court order lasted till the day the appeal court gave a substantive ruling on the matter. So, all decisions taken by Oshiomole from the day the stay of execution was issued to the day the court of appeal gave judgement remains legally valid. It is also important to note that the power to constitute screening and primary electoral committe belongs to the NWC and not the party chaiman. The NWC can validly constitute the committes without the presence of the party chaiman in as much as the meeting where it was done was validly called and quorum was formed. The fact that APC NEC later endorsed all the decisions taken is just an icing on the cake. The decisions were valid ab initio.

There is few major different between Edo APC state wahala and other ones .
1. Gaidom was in the meeting where the ratifications were made
2. The contestants did not object POI emergence
3. The list was submitted to INEC by the constituted caretaker committee that was ratified by the NEC and supported by ALL factions.

Adoption of past decision made by both factions has punctured any further claims.

Instead of going this way I would have advised Obaseki to face the campaign and stretch for reconciliation like Akeredolu of ondo state. Politics is a game of number and I don't he has the number. Losing Capt Hosa in this dying minute is suicidal.

For any matter concerning primaries or election,it must be filed within 14 days.all decisions taken by either oshiomhole or giadom or apc nwc is subject to nwc just like buhari appointments of ministers is subject to Senate approval

I said it in some of my posts that Obaseki only hope is Wike and court to win election. grin He once raised a similar issue recently in a Benin court asking the judge to disqualify Ize Iyamu for not having an APC membership card from his ward but the court told him and his counsel to mind their business after all, they are no longer a member of APC. He is now sponsoring Ude forgetting that there was status quo by the appeal court when they gave judgment on Oshobaba case and moreover, it's a pre election matter on intra party case that can only be put forward by the actors in the primary election and not an outsiders like Obaseki and his puppets grin
You're quite naive to think Obaseki is directly behind this. Mind you, he had plans to institute this case at a set time, no doubt; but if you're aware of the role Ude has played in Rivers APC crises, you'd know who is behind it. You folks think Edo 2020 is all about Obaseki vs APC, it's between APC and APC, a power play for 2023. The realignment that will happen before then would shock you, just as you would think the NDDC saga is an isolated event. Amaechi is cooking up something with certain powers that be in APC.
