Fani-Kayode's Libel Suit Against Daily Trust is Needless Self-Injury--THREAD

Whoever advised Femi Fani-Kayode to sue Daily Trust over a scathingly unflattering opinion article that an occasional contributor to the paper's opinion pages wrote about him doesn't love him. Most of the unsparingly virulent things the writer wrote about Fani-Kayode qualify as opinion and fair comment in media law and are not actionable.

The only potentially libelous statement in the piece is the claim that Fani-Kayode is a drug addict who had been treated, without success, in psychiatric hospitals in Ghana (and other places) but who hasn't recovered from his drug addiction. That's not an opinion that enjoys constitutional protection; it is a statement that implies a definitive habit of moral turpitude that can be proven to be either true or false.

Nonetheless, truth is a defense in libel. If FFK goes ahead with the lawsuit, Daily Trust would be compelled to prove that he was indeed a drug addict who had been treated at psychiatric hospitals. In proving this, Daily Trust’s legal team would expose FFK to even more public
ridicule.

But, even worse, if Daily Trust finally proves it, Fani-Kayode's reputation would be so irretrievably sullied that he would become what defamation lawyers call a “libel-proof plaintiff,” that is, someone whose reputation is already so thoroughly damaged that no libelous statement can damage it further. Plus, he is a public figure who seeks out the media, who willfully thrusts himself into public consciousness, who seeks to influence national conversations, and who has the capacity to respond to whatever dirt that is thrown at him.

Such people have a hard time winning a libel case. If the man is wise, he should just lick his wounds quietly and withdraw his threat against Daily Trust. It would hurt him more than it would help him.

I may write further on this in my back-page column in the Saturday Tribune.

This matter should be rested. Both side should sheath their swords. FFK has rendered an unreserved apology and we must not play into d hands of d tyrants who know FFK is a torn in their flesh and are sustaining this campaign of demarketing FFK. You can not call someone a drug addict and expect him to be clapping for you. Whether an opinion contributor or an editorial, Daily Trust should not have allowed their tabloid to be used in publishing same. You reading this btw d insult by FFK on d journalist and d rather libelous drug addict mantra labeled on FFK which is more demeaning? I leave u to your conscience.

Fani Kayode should have politely answered the poor journalist question in a gentleman manner even if it sounds absolutely ridiculous or allegedly insulting. Now he has put himself on the spot with his own insults.

"Shigidi to ba fe te, ani kiwon gbe oun lo sodo lo we".

The above Yoruba proverb succintly applies to FFK at the moment. He has been peddling lies against others and nemesis has decided to catch up with him and publicly disgrace him. He has challenged his "CHI" to a duel and he will definitely go down. FFK is on a downward slope, he's never getting up again.

He's prostrated and offered fake apologies all over the place, but he reused to apologize to the Daily Trust, the same media house that he abused and insulted, he's instead sing them.

FFK should proceed with the libel suit, the onus is on Daily Trust and the columnist to prove if truly he is a drug addict who had been treated, without success, in psychiatric hospitals in Ghana (and other places) and hasn't recovered from his drug addiction.

The next 14 days will be interesting.

With his kind of utterances will that be hard to prove? How many countless times has he called VP Osibanjo and even the President unprintable names
He calls Vp or president unprintable names is irrelevant. If he libeled them, they would have sued him.
Ffk has been defamed and he has taken the legal part

The guy needs to go work on his ego.

We need civics and communication classes in Nigeria, like on a TV and street level. Our arrogance, insensitivity, and ego is even off putting to me.

Leave FFK alone to contend with the body of the ...THIRD FORCE!
He would later realize that a child that plays with ants infested fire-wood for his meals will have many bites that renders the meal useless at last
