senatorial aspirant in Ogun West Senatorial District, Mr. Deji Adeleye, has initiated a suit before a Federal High Court in Abeokuta against the Peoples Democratic Party, the senatorial candidate of the area, Mr. Babatunde Fadun, and the Independent National Electoral Commission over alleged malpractices in the conduct of the party’s primaries.



When the matter came up on Thursday before Justice Rita Offili-Ajumogobia, the lead lawyer to the plaintiff, Mr. Oluwarotimi Akeredolu (SAN), urged the court to grant an interim order restraining Fadun from parading himself as the candidate of the party for the election.



The plaintiff is further asking the court to declare him the winner of the PDP primaries held on January 7, 2011 at Ansar Udeen Primary School, Ilaro to select the candidate for Ogun West.



He claimed that the poll was marred by various irregularities and electoral malpractices and urged the court to invalidate it.



“Being dissatisfied with the conduct of the primaries, the plaintiff reported the matter to the police where the official admitted that it was the second defendant (Fadun) that gave them the red bag used for the election.



“They said that without the knowledge of the plaintiff, they appointed two men to write for the illiterate voters their choice of candidate. But they could not produce the two men when demanded by the police.”



The lead lawyer to the second defendant, Mr. O. Amoo, urged the court not to grant the injunction.



The case has been adjourned till March 14 for ruling on the interlocutory injunction.
