Man Caned Twenty Times For Stealing Handsets In Church

A twenty-year-old man, Shina Oyerinde, has been given 20 strokes of the cane for stealing seven mobile phones estimated at N150, 000 in a church in Ilorin.

The punishment was ordered by an Ilorin Magistrate Court which also ordered the convict to cut grass around the court premises and pay a fine of N1,000.

The Magistrate, Mrs. Sherifat Olanipekun, passed the sentences on the man after the court found him guilty of stealing the mobile phones.

According to Police First Information Report, men of the National Security and Civil Defence Corps arrested the convict in a church with the stolen items. "The accused was arrested by men of the National Security and Civil Defence Corps (NSCDC) inside the church with the items on him," the report added.

The report stated further that when the convict was arrested with the items, he could not give satisfactory report on the sources of the seven mobile phones found on him. "When the NSCDC men searched him and found out the seven mobile phones, the accused could not give satisfactory answer on the sources of the items," the report said.

The Magistrate, Mrs. Olanipekun in her ruling ordered that the man should be given 20strokes of the cane and should also cut grass around the premises of the court. "It is obvious that the prosecution has proved its case beyond doubt and the accused is guilty of the offence. He should be given 7strokes of the cane, cut the grass around the court premises and he should also pay a fine of N1,000," Magistrate Olanipekun ruled.

The caning of the convict was carried out inside the court room by a police man.

This is weird. In as much as I support corporeal punishment and fines over jail term, where is it in the constitution that people should be flogged by Magistrate Courts?

This Judge should be fined not less than N150,000 which sum of money should be given to the defendant. She should also be sacked from the Judiciary. This is crazy! I can understand that it is annoying for somebody to be stealing in a church but if even OBJ was not allowed to bend the constitution, why should a Magistrate Judge do it?

I just wish justice would be done on the magistrate, This would have been a get-rich opportunity for the victim who was flogged. I blame Islam for this mentality: she's a muslim, right?

The magistrate is trying to instill moral values that the new generation is lacking. please did anyone say anything when IDIAGbon was using soldiers to flog our ass for coming to school late. ?   shocked  shocked cheesy

Personally, I think flogging is far better and more humane than imprisonment.
It's a waste of government money and people's lives to imprison people for minor offenses.

See, I'm in support of all this flogging and fining and even capital punishment. But what I will not support is a breach of our constitution.

If the Senate of the Federal Republic of Nigeria declares me president, in as much as I would like to be in charge of running this country the right way, if it is in breach of our hallowed constitution, I will reject it.

Let us not allow unconstitutional illegalities no matter how well meaning they are; no matter how in line with our philosophies they are.

The man who was flogged should be compensated with a fine to be paid by the magistrate, then furthermore, the magistrate should lose her job.

Why don't we use our brains for a moment. Isn't public disgrace a very powerful motivation tool?

If you are asked to choose between 3 months in a Nigerian prison and flogging, won't you chose flogging?

I agree with Seun, it is much better than sending people to an overcrowded prison where the he would mix with worse crimnials and get no correction whatsoever.
I have always prefered alternative forms of punishment to sentencing people to rot in prison.

This is what is spoiling this nation. It seems good but is it the right thing. Did third term not seem good to Obasanjo? Why didn't we let him carry on.

So why should this Magistrate carry out an illegality and because it seems good we all want to look the other way.

What is wrong is wrong. Stop supporting what is wrong because it is in line with your personal views.

I for one do not see a reason for prisons, prison was not originally punishment. Prison was a place used to keep people while they await punishment. So in as much as I do not like imprisonement except with productive labour, I will not support floging till it is instituted in the law under which it is carried out.

And believe me, if this flogging was carried out under Sharia law, I wouldn't complain because it would be legal.

Let us condemn all illegalities and every unconstitutional act.

Common sense is more important than the letter of any law. The intent of the law is to reform criminals, and we're saying that for petty theft, being flogged and asked to cut grass is likely to be much more effective. If the law doesn't allow this effective measure, then let the law be changed. Thanks.

in line with that common sense, the Sharia Law is provided which encourages flogging. A judge that supports this form of law should practice in a Sharia court. Is that not common sense?

They have weapon and you have hands, they will beat the crap out of you, please don't argue with this boys oh, all they understand na go. ask FELA. So what is the problem here ? Is there somewhere in our constitution that prescribes sentences for every crime ? I think Judges/ Magistrates are allowed to use their knowledge and discretion in awarding sentences, as long as it is in line with our criminal justice system. (I stand to be corrected)
The sentence could be a flogging. It doesn't mean it is an Islamic sentence.
Must every criminal offence be punishable by a jail term, when we know very well that the jail is one of the best breeding grounds for hardened criminals. Minor offenders go in there and come out hardened dare devils

Why dem no Mike Adenuga give Mike Adenuga such summary sentence including public flogging and cutting grass? That Magistrate has serious questions to answer.
