CHARGE COUNT #5 & SIMPLIFIED EXPLANATION


*Count Five:*
That you Nnamdi Kanu, male, adult, of Afaraukwu Ibeku, Umuahia North Local Government Area of Abia State on the 22th of April, 2021 in London, United Kingdom on Radio Biafra monitored in Enugu, Enugu State and other parts of Nigeria within the jurisdiction of this Honourable Court did an act of terrorism in that you incite the other members (followers) of the Indigenous People of Biafra (IPOB}, a proscribed organisation in Nigeria, to look for security personnel, their family members through a Radio Biafra on 102.1FM monitored through the IPOB Community Radio and you thereby committed an offence contrary to and punishable under Section 1 (2) (h) of the Terrorism Prevention Amendment Act.


TERRORISM PREVENTION ACT (TPA-2013) EXCERPT:
*Section-1 (2)(h): A person or body corporate who knowingly in or outside Nigeria or indirectly willingly incites, promises or incudes any other person by any means whatsoever to commit any act of terrorism or any of the offences referred to in this Act, commits an offence under this Act and is liable on conviction to a maximum of death sentence.*



*SIMPLIFIED EXPLANATION*
The section quoted above simply deals with the act of inciting others to commit act of terrorism.
This section does NOT contend whether the act of terrorism was actually performed. It is simply saying that "if by your words or action you incited people concerning an act of terrorism, then you have committed a crime.

So the questions now are these:
*(1)* Is there any evidence to prove that the accused, on the quoted date (April 22, 2021), say anything inciting, as noted on that charge?
*(2)* Did he ask his IPOB members to look for security personnel and their family members and if he did say so,
*(3)* What did he tell his IPOB members to do to the securiry personnel and their family members when they find them?

These are the questions we should ponder on.

It is immaterial whether the act of terrorism was committed or not. The main issue here is whether he incited some people and if there is evidence to show that he actually made a broadcast on the said date and his words were inciting.

Physical commission of the act of terrorism is not the focus here, but saying something that is inciting justifies indictment (under above-stated section of TPA-2013)
