Update from SIGGY .ng Two female students of Igboye community secondary school, Igboye, Epe, Lagos state have been stopped from writing their school exams until they pull off their hijab, Siggy reports. They were denied from joining their classes for revision as well last week. The father of the said students visited the school and showed the principal Mrs Odushoga the court judgments as well as the memo on Hijab, she was adamant that the students will not be allowed. The father had hitherto considered withdrawing his children, but since they were about to write exams, he brought them back. This would have been a good report if it provided us with government position on hijab use in schools and also the objection of the principal involved, as to why the students weren’t allowed. So no one has unlimited rights; the school principal has serious obligations and I think if the individual can justifiably show how the students right to Hijab impedes on whatever obligation she has, there can be a negotiation of thoughts to determine which is superior. It would seem such negotiation of thoughts have existed over the years and the Lagos government directive is a deferential to the supreme court, that the student religious liberty to appearance be upheld in public schools in Lagos state. I will try to talk to the position of the government as available, far back 2018. Since the year, it is possible the position has changed, however, I could not get hold of any such change in position. The instruction then which is perhaps still valid was fluid and left to the discretion of the Supreme Court. The instruction reads “Since the case of the use of Hijab in Lagos State is still pending in the Supreme court of Nigeria, status quo be maintained, to avoid contempt of the court, that is students be allowed to wear Hijabs on school uniforms but same must be short, smart, neat and in the same colour of the uniform (skirt),” I think folks should be allowed to exercise what their faith dictates without discrimination from others or bullying and I believe as a layman in the subject of Law, the Supreme Court dictum would be based on the individuals right, part of which is religious liberty. However for it to go up to the supreme court, the issue is not so layman, but that there are consequences or conflicts of rights that allowing Hijab use, forces. What has been the status quo in the school? What has been the norm? Have they allowed the use of Hijab in the past? How have the students attended classes then? Was it with the Hijab? Are the parents of the girls all of a sudden insisting on their child’s rights to Hijab in the school, despite the leaning of the school to not permit it in the past? These and more are questions that if answered would aid understanding the scenario better, but while they are important questions, there can be no justification for flouting the government directive to recognise the students right to Hijab in such schools and I believe the Principal has no ulterior motive to do this as she risks if not her life, then her livelihood and her reputation to be fair and not be a bigot. Overtime, I think fear is been incorporated into our institutions, but for years, Muslims have lived, submissive to the society at the cost of their belief or the instruction of their belief, yet overtime, fear is been incorporated into our institutions. By who? By folks tired of the oppressions Muslims may face, but Islam itself is oppressive compared to other religions, it has clear instructions of how to fulfil its mandate which is not consistent with peace or with the existence of a secular state, but increasingly, there is a rise in Muslims, protesting their abilities to exhale, a rise in Muslims seeking to fulfil some of the harmless instructions of their Quran, even here in the south. Education should be a facility to liberate, and when our educational institutions becomes beholden to religious sentiments and rule, I fear the worse, but our educational institutions as well must teach tolerance and be the template for our society in the recognition of individuals personal liberty but damning the reason why Hijab may be objected to, can be a reckless course; to merely reduce those objecting, to Islamophobic is also a reckless course and it becomes dangerous in its proclivity for violence, that is why in some places, those who may objects get killed, while in the south here, it's increasingly becoming, that taking one's livelihood is the punishment or sentence for such objection. If one is in a position to obey the state, to ensure the rights of others and one does not do that or betrays that duty, then it is right that such responsibility is withdrawn from them. The Principal is a case study, however the Principal may not so much be disobeying the state or disregarding or discriminating unlawfully anothers religious liberty, and that is why before asking for her head, we should give the head a chance to speak as to the reason. Somehow, that has or may not have occurred, but what I know is that what underlies her position is absent, and such absence raises my suspicion and even about the NewsMedia in its laziness, and in its inclination to divide people further and arouse dangerous sentiments across religious lines. 5 Likes |

talk2hb1: Wearing of hijab is a cultural and not religious practice and obviously not a pillar of Islam or mandatory practice. A Muslim woman who doesn't wear hijab is no less a Muslim than one that does. The Quran specifically advocates decent dressing for women and to lower their gaze in public. Any reading of such decency to mean use of hijab is purely the opinion of one or more clerics advocating the position. It is therefore tiring to see some Muslims trying to forment trouble on that issue, to the extent of registering a Hijab Advocacy Initiative! Section 38(1) of the Constitution makes provision for the citizen’s "freedom of thought, conscience and religion, including freedom to change his religion or belief, and freedom (either alone or in community with others, and in public or private) to manifest and propagate his religion or belief in worship, teaching, practice and observance." Now if you want to say Section 38(1) of the Nigerian Constitution supports the use of hijab, then it would also be interepreted to support a wide range of conflict inducing practices in the name of religious freedom. For example two of the five Pillars of Sikhism is non-removal of hair (kesh) and carrying a dagger (kirpan). That means a Sikh student in a school in Nigeria should be able to come to school with a dagger, long afro hair and bushy beards as a constitutional right. The prevention of some religious people such as Christians from preaching in public buses is also a violation of their constitutional right to propagate their religion. Islam's apostacy and blasphemy laws are also violations of the constitutional rights of any alleged victim. If you can see the potential for chaos in a misreading of the Section 38(1), then you would understand how hijab wearing cannot be protected by it. |

talk2hb1: It would do well for you to do some of the education with authoritative sources and establish how the Quran mandates hijab with direct quotes from the Quran. It should be a simple affair for you rather than an evasive "do you homework". The clearest verse on the requirement of modest dress is Surah 24:31, telling women to guard their Instruments and draw their khimār over their bosoms. How does this verse mandate hijab? I have take time to draw a few sources from the internet that is easily accessible to all like the Wikipedia entry on Hijab which is detailed and shows the various conflicting positions on the issue as well as the lack of a direct Quranic instruction to back the mandating of hijab for women. Check https://en.m.wikipedia.org/wiki/Hijab It is also interesting to note that wearing hijab in public is not required by law in Saudi Arabia and that veiling of women did not originate with the advent of Islam. Statuettes depicting veiled priestesses date back as far as 2500 BC.
