Uba Appeals Court’s Disqualification As APC Candidate by Kwanza: 2:30pm On Dec 23, 2021
The Governorship candidate of the All Progressives Congress in the November 6 Anambra State governorship election, Senator Andy Uba, has formally appealed the judgment of a Federal High Court disqualifying him as the candidate of the APC.

Justice Inyang Ekwo of the Federal High Court, Abuja had on Monday, nullified the Uba’s candidacy on the grounds that the party did not hold its primaries.

In a statement on Wednesday, the Deputy Director, Senator Andy Uba Governorship Campaign Organisation, Mr Ikechukwu Onyia, said a 15-page appeal was filed on December 21, 2021.

According to the statement, the appeal was predicated on eight grounds, principal of which was that Justice Ekwo erred in his verdict.

One of the eight grounds of appeal dwelt on the issue of lack of territorial jurisdiction by Justice Ekwo’s division of the high court.

Onyia insisted that Ekwo’s arrogation of jurisdiction to his court was in error.

He said, “There is enough evidence for the appeal to succeed as Justice Ekwo should not have proceeded with the matter in the first place since his court lacked territorial jurisdiction to entertain the matter.

“The appellants are most confident that the appeal will succeed in the face of the very strong grounds on which it is premised.”

He’s a fool.

Whenever I see or hear Uba, I see the stupidity of those clamouring for direct Primaries.

They claim Direct Primaries would take power out of godfathers and hand it to the people, yet Uba was able to hijack the entire process and emerged candidate against the wish of the people and even party stakeholders.

This is what fools want us to start wasting billions of taxpayers money on only to still be manipulated.

The courts have spoken. Uba was never a candidate in the Anambra Election and his case at the Tribunal should be struck out with immediate effect.

I see it as a waste of time even if the appeal court sets aside the judgment for lack of jurisdiction, when they look into the matter, they will still give the same Judgement as the lower court.

Jurisdiction is the lifeblood and existence of any case.

No matter how finely worded a case is, once there is no jurisdiction every decision on it is null and void.

Once the Appeal Court establishes that there is no jurisdiction like I suppose they will, the judgement of the Federal High Court will be thrown out.

Where Moghalu lives is immaterial in this case. The Summons determines the subject matter which is the validity or otherwise of the APC Guber Primaries in Anambra.

If for example, Moghalu had won the primaries and his name submitted but APC decides to change his name....he can restrain the party or challenge the outcome in a Court in Abuja. See Ozigbo v PDP.

The only argument of Moghalu now will be that the Federal High Court is one with unlimited jurisdiction, however there is a FHC in Awka.

You forgot to add that he wrote for himself 230,000 votes from only the Apc primary which the general election of the whole Anambra state cannot boast of... The direct primary is an open cheque to write any number you desire.

You seem to be forgetting that cancellation of the primary was not the only relief Moghalu asked the court for which were granted. He also asked for a full refund of the money he paid to APC which is domiciled in Abuja. He also asked for INEC to erase the name of Andy Uba as the APC candidate which INEC accepted from APC in their headquarters in Abuja as INEC timetable required at the time. So Abuja has everything to do with this case.
