5 MISTAKES LANDLORDS MAKE ON THEIR PROPERTY BY DENNIS ISONG


Two years ago in Oyo town, Owode, to be precise, a room in one of the old houses was rented out to a man. After a few months of familiarizing himself with people around, he asked the Landlord to allow him to display a few of his things in front of the house (he sold household gadgets) and he was allowed.

After another 6 months, he told the landlord that he was traveling and since there’s no issue with that, the landlord didn’t read any meaning to it.

One week after, a woman (Mrs. B) came to the house to ask for him, and the landlord reported that he had traveled. The man that followed her asked the landlord a few questions, unfortunately, he couldn’t answer. So, he was arrested.

The man that followed Mrs. B was a police officer and no one knew because he wasn’t wearing a uniform which was on purpose.

When they got to the station, it was made clear to the landlord that he had accommodated a wanted 419 and he had to produce him.

The landlord explained to them that he ran a business and he hadn’t moved out. And then, they went to check his room. On getting there, they saw that he had cleared all the things in the room unknown to the landlord.

This case went on for weeks before the landlord was eventually bailed. Many people in jail now are not supposed to be in jail but it happened for the little mistakes that seemed irrelevant initially.

Tenants can leave your house within a twinkle of an eye and you may not know the havoc they must have caused until it becomes a police case.


What are the mistakes landlords make?

1. Not having any traceable information about the occupants

Many landlords, especially those that are not living in Nigeria or close to where they have their property are guilty of this. When you leave your property in the hands of agents, do you also monitor the kind of people moving into the house? It is your property and there should be a level of zealousness just to avoid cases like the one that happened in Oyo. There are too many criminals out there frantically looking for accommodation to perpetrate evil.
When people come to you, do your background research. I know of a landlord that calls potential tenants' place of work just to confirm that they truly have a legitimate job. Little research is paramount, don’t take it for granted.


2. Accepting occupants based on emotions

People do this. We hear a sob story and lose our guard. Bad people take advantage of this. All stories you are being told must be verified. You are not a bad person trying to protect your property because if push comes to shove, you (the landlord) will bear the larger burden of the problem.

You should do away with emotions so you can make a sound judgment.

3. Not having rules binding tenants to the house

This is very important. don’t treat your property nonchalantly. Set rules for occupants and make sure you also follow the rules. Not having rules is a mistake you should not make as a landlord because you are just setting yourself up for a big problem.

One of the things that should bind you, the tenants, and the house rules. Without rules, it will collapse, literally. Rules binding tenants will curb excesses. There might be issues but it won't be as horrible as not having any rules.

4. Handing over the affairs of the house to a tenant also living in the same house

Landlords make this huge mistake. I am sure you might be wondering why and who should have been in the best position for it. I will tell you why. Do you think a tenant being put in charge of others will be neutral? Do you think he/she will be totally sincere with you? Do you think he/she doesn’t have a close friend and an enemy in the house and makes things favorable to one while the other is at the receiving end because of personal issues?

In this situation, where the “house captain" also lives with the subordinates, it brings chaos and disarray eventually.

The best fit for the job is an outsider who will be neutral and not emotionally attached to anyone.

5. Gossiping about tenants to one another

Please don’t do this. If you have an issue with any tenants, approach/her on a personal level. Gossiping about tenants to one another gives room for disrespect and I am sure it’s not something you want to deal with.

In some communities, if a tenant is going beyond his boundaries, he is allowed to make a report to the landlord’s association and such cases will be treated accordingly.

Recently, co-working spaces are in high demand now for entrepreneurs and self-employed experts for rent. And with the present economy, it’s a great idea because it has proved to be prudent, economical and affordable.

People easily jump on this and it’s advisable to leverage on it as an office investor. One main advantage you should expect is high tenants’ turnover rates.
In a place like Lagos, there are offices which have modern facilities needed for co-working spaces. Some of these offices can accommodate 4 to 5 people at a go and this works well for entrepreneurs who need physical space.

One good thing is that they do not have to go with the traditional model of rental payment which is mostly annually. The mode of payment is monthly, so anyone can decide which of the months he/she will be available without the fear of tying down money (rent fee) unnecessarily.
Asides from this, you should lookout for competent occupants that pay rent come rain come sunshine.

4. Be careful with the structure you buy.
When buying an office property, make sure that it’s a solid infrastructure. Avoid properties that would dig into your profits because you have to permanently repair them due to their poor condition. This may turn off future buyers and lenders. And also, stick with designs that won’t gulp your money or require endless maintenance such as using a lot of wood and stucco.

Finally, and most importantly, a good location works out well for office property and while looking out for location, do well in studying the type of lenders and price tag. Also, your building should be in great condition because this is one major factor that would determine the category of lenders.

When he turned 40, he decided that he would like to give back to society by building an old people’s home in his hometown. Then, he had to buy land to build on. As someone who had no prior experience when it comes to buying properties, he was deceived by people who posed to have an expanse of land for sale.

Quite alright, he was given a few documents but not the accurate ones. He didn't realize this until the rightful owner with all the required documents showed up.

Unfortunately, he tried to find the people who sold the land but they were nowhere to be found. That’s how Thomas lost all his money.

This is one of the many experiences of people when it comes to buying land in Nigeria. Incomplete documents can make you lose a property you have invested so much on.

1.Deed of Assignment/ Deed of Transfer

Although, the abstract of title, the epitome of title, and payment receipt ought to have been different documents, they are all contained in the Deed of Assignment.

2.Certificate of Occupancy

The Certificate of Occupancy is one of the most important land documents in Nigeria. It can be used to certify the legal ownership status of any land in Nigeria. It is the document that indicates that an individual has been granted a statutory right of occupancy by the Governor of the state or a customary right of occupancy by the Local Government Chairman, where the land is situated in a rural area. This document is also very important where the property in question is on a land that was acquired through a state grant.

3.Approved Survey Plan

Another important document to ask when buying a land in Nigeria is the approved survey plan, because it clearly marks and defines legal boundaries, helps reveal the true ownership status of a property, and also reveals if the land is under any government acquisition or committed area.

This document will become even more important where the house is bought along with surrounding land.

4.Duly Perfected Assent

The personal representatives divest themselves of the real estate of the deceased through an assent. This is required where the house belongs to the estate of a deceased, in this situation, it becomes mandatory for the buyer to request for a duly perfected assent from the personal representatives. He can even go further to verify if letters of administration/probate have been granted.

5.The Sale and Purchase Agreement

The Sale and Purchase Agreement contains a list of terms and conditions that are agreed to by both the buyer and the seller. An excellent example of this would be the negotiation for the price of the flat. The agreement would contain the agreed amount of the flat by both-the buyer and the seller.

6.The Building Approval Plan

Before the commencement of construction, the builder is required to get the necessary sanctions under the provisions of the Building Bylaws, Master Plan and Local Body Acts. This sanction involves two factors:
A) The Building Plan
B) The Layout Approval
One mistake that first time land or house buyers often make is not ensuring that the builder meets the terms and conditions of the Building Plan and Layout Approval before buying the house. Not meeting the terms and conditions could end up in negative results if the local authorities come in for spot checks, which are quite common in newer buildings.

7.The Mother Deed

The Mother Deed is an important document which traces the ownership of the property. This document is generally required by banks when a buyer avails a loan against the property. An individual may approach the local authorities for help while creating this document.
