Under the Nigerian criminal justice system, the country is polarized into two criminal laws: Southern Nigeria and Northern Nigeria.
The Criminal code is applicable to Southern Nigeria, while the Penal code and Sharia law is applicable to the Northern states.

SOUTHERN NIGERIA
Under the criminal code applicable in Southern Nigeria, adultery is not a crime, hence, a person cannot be punished for adultery in Southern Nigeria. The cheated partner is protected under the Marriage Act. The Marriage Act gives party in question the power to ask a court for a divorce and claim damages.

NORTHERN NIGERIA
In Northern Nigeria where the Penal Code applies, adultery is a criminal offence. Adultery is punishable with 2 years imprisonment and/or with an option of fine.
