Osun PDP Primary: Adeleke Faction Kicks As Court Nullifies Delegate Congress by EcoBrick: 5:59am On Mar 06, 2022

Faction of the Peoples Democratic Party, PDP, loyal to Senator Ademola Adeleke have described an Osun State High Court injunction nullifying the delegate congress of the party as ineffective.

A State High Court, sitting in Ijebu-Jesa had on Thursday, nullified the ward congress held by the Peoples Democratic Party, PDP, in the state ahead of it governorship primary election.

The court, presided over by Justice A. Aderigbigbe while ruling on an experte motion brought before it by some elected ward chairmen of the party, said the ward congress held by the Soji Adagunodo-led State working Committee on September 25, 2021, is the only valid congress, hence, the delegates elected from the congress are eligible to vote at the party’s primary on Tuesday, March 8, 2022.

The party’s Director of Media and Publicity, Oladele Oluwabamiji, while speaking with newsmen on the matter, said the exercise is an abuse of court process, saying the court, contrary to it power, is meddling in party affairs.

“Such injunction does not hold water, as far as we are concerned. We have a Supreme Court declaration that court can not dabble into the affair of political party. We know that some elements in the party are trying to carry out hatchet job for APC.

“We have already move ahead of their antics. The national body of our party will react to that. We will handle it and react appropriately.

“We are going ahead with our primaries on Tuesday. I can only advise the national body of our party which conduct delegate congress, including the one in question to be firm with it decision. The party leadership in Osun does not manufacture delegates. The national body will come with the appropriate list”, said Oluwabamiji.

He added that the Appellate Court sitting in Akure, Ondo State had already adjudicated over the matter, nullifying the congress held by the former party chairman.

He said the National leadership will react on the matter appropriately, but added that the party will go ahead with it primary election on Tuesday as scheduled.

*Anigba Adagunodo group should renounce the party membership instead of irrational court order!!*

There are lot of Supreme Court decisions on internal affairs of Political Parties. The recent one is Aguma Vs APC ( in respect of crisis in Rivers State Chapter of APC). Supreme held that Court lack Jurisdiction to dabble into internal affairs of a political party, Apex court also held that a Political Party is a voluntary association and any member of a political party who fills not satisfy with the internal arrangement of a Political Party is at liberty to renounce the membership of such a political party.

Appeal dismissed and Supreme Court affirmed Rotimi Ameachi led faction of APC in Rivers State.

Are these people still in PDP any longer?
They are acting the script of APC after collecting #25milliom to truncate due process of 3 ad-hoc delegates last week.
Their plan did not work with the transparent manner the congress was handled by His Excellency Ahmadu Umaru Fintiri and his team.
Once the congress had been approved by the National Working Committee of the party, the list cannot be nullified by the egocentric individuals parading themselves as APC members Osun but whose actions run contrary to the reality.
Quite unfortunate for them, the Electoral Amendment Act 2022 had been signed by the President that oust election matters from the jurisdiction of the State High Court.
If these recalcitrant Anigba Group are sure of themselves, let them take their matter to Federal High Court as contained in the Electoral Amendment Act 2022.
They are throwing banters at us by bringing forth this mandatory injunction to course confusion.
Let me assure our people that PDP cannot be distracted in holding the governorship primary election on Tuesday 8th,2022.
It is trite in law that court cannot interfere with internal mechanism of political party.
The issue of recognising the executives under the Chairmanship of Soji Adagunodo by any State High Court is judicial rascality that cannot work.
The only recognised structure of the party,National Working Committee had approved the list of the 3 ad-hoc delegates conducted last week. There is no court that can subvert this duly conducted Congress.
Let their lawyers that are prompting them to misbehave in this manner controvert my position on this matter if they are sure of themselves. The era of acting with impunity is gone in PDP.
I will only enjoin our people to remain cool and calm.
The NWC of the party is on top of the situation.
They will issue consequential directives regarding this matter at the nick of time.
God bless you all.

Thank God the Conduct of Congresses or Primary Elections is not the function of any state secretariat or Party Chairman.

Anyone who has legitimate grouse with how the previous Congresses were conducted should approach the NWC who conducted it. Or they can also take the NWC to Court.

The position of the Law is very clear.

Let those who believe they have the political clout to defeat the People's Governor and popular choice Candidate meet us at the Primary Elections venue on Tuesday.

In any Democracy, The will of the absolute Majority and is based on numbers. The tiny minority can only talk according to Sir Henry willinkins .

Press Statement
05/03/2022

*IGNORE DISTRACTIONS AND GET READY FOR TUESDAY, ADEMOLA ADELEKE URGES SUPPORTERS*

Ahead of next Tuesday governorship primary, Senator Ademola Jackson Nurudeen Adeleke has called on delegates and party stakeholders to support his candidature as he is prepared to defeat the incumbent governor at the July elections.

In a statement issued on Saturday, the frontline governorship contender appealed to his supporters not to be distracted as he urged them to get prepared for the Tuesday governorship primaries.

Adeleke called on party delegates to ignore any distraction and get set to attend the state Congress even as he assured them that his candidature is a strong ticket for the PDP to win the governorship election.

"I want to use this opportunity to call on delegates to troop out to vote on Tuesday. I seek your votes to be the candidate of our great party in this July election. I am prepared in all aspects to lead our party to victory.

"Don't be demoralised by any insinuation. Exercise your right to vote as a delegate. I seek your endorsement. Our great party is on top of the situation with respect to developments in some courts. The party legal team is also doing its best to ensure plots to paralyse the party fail.

"Our party faces externally induced legal attacks. Agents of the ruling party are desperate to stop the party from participating and winning the state for the PDP and the people. But as they failed in the past, they will fail on this new attempt. It is however our duty to remain calm and be persistent to exercise our rights as delegates.

"We are set for Tuesday. It is my conviction that no force can stop the will of God and people. Our ambition is to return government to the people for collective good. We will achieve that goal with the backing of God and the people", Senator Adeleke said.

THE POLITICAL REALITY OF THE MOMENT IN PDP OSUN STATE
( written by Barrister Rotimi John Adeyenuwo)

Whoever that is calling himself Oloto 1 should go and study Law in University to qualify him to be abreast of Procedural Law being taught in the Nigeria Law School.
Law is not a field a nonentity can brag to have solutions to all the problems arising therefrom.
If there is anybody in Anigba Group emboldening you that there are rays of light at the end of tunnel for your group, just tell the person to stop misleading you.
In Law,there are rules and precepts to follow in determining a case. Any attempt to cut corners to arrive at justice as in the instant case will be rebuffed.
For the sake of people your post may want to confuse, let me try to throw light on the subject matter for clarity sake.

RIGHTING THE OBSERVABLE WRONGS IN ANIGBA GROUP MISCONCEPTION OF THE LAW

Let me start by saying the just passed Electoral Amendment Act 2022 is not ambiqous in its interpretation.
When your Anigba Group brought this spurious injunction yesterday to confuse members of the public, intelligent people on our side swing into action to diffuse the tension it engendered by enlightening the whole public that your group are just talking gas without recourse to Law.
If we are not conversant with the new Electoral Law as amended, you would have hold us into ransom with your Anigba Group's intention to force us into reconciliation in line with your concluding paragraph of your post here that "lts time to come together and win together, l stand with PDP".
Bi egungun ba mon pe oun ti n pada bo wa di eniyan ni,iwonba lo ma roro mon ninu eeku egungun.

If your Anigba Group believe in Section (13) of Electoral Amendment Act 2022, you won't be running from pillar to post trying to procure a useless State High Court injunction based on ex-parte motion all about.
Stricto sensus,Section(13) of the Electoral Amendment Act 2022 says "Nothing in this section shall empower the courts to stop the holding of primaries ...".
Not that the word "Shall" as quoted in this section is the operating word in the provision.
If it is dawn on your group that you are handcuffed by this mandatory clause, that should not give you the impression that "IMOLE SUPPORTERS are making a great mistake with a section of Electoral Law they are circling and circulating" as you claimed in your write-up.

Let me tell you that we have studied this provision clearly well before we come on the air space to rubbish your kangaroo or worse still Jankara injunction.
Section(12) of thesame provision commands an aspirant or a group of aspirants as in your Anigba Group case to seek redress in the Federal High Court.
If your leaders are not bent on ruining your political lives, they should have thinkback before rushing to an obscure State High Court somewhere in Ijebu-Jesa to procure a filthy injunction.
Accepting the fact that "COURT doesn't stop TEUSDAY's primary election as you are now claiming here is an afterthought of your group feelings.
We know you are playing with your testis. Now that its skin has broken,it remains your problem.
Your Anigba Group will contend with that falsehood for a long time out of stupidity.

Concerning the second leg of your assumption that the "Court only nullified Kangaroo Ward excos under the leadership of Sunday Bisi and approved ward congresses conducted under the leadership of the former State Chairman of the Party,Olasoji Adagunodo for Tuesday March 8th,2022 governorship primary,2023 House of Representatives primaries,House of Assembly primaries, House of Senate and State Party Congresses, let me point it out to you that the claim is the figment of your group's imagination. When has it become the duty of courts to usurp the functions of a well structured political party such as PDP?
Let me clear your ignorance by saying that Soji Adagunodo had been removed from office as the State Chairman by the decision of the National Working Committee which was later ratified by NEC at the Party's Convention as the time the Congresses were held..
In order to fill up the vacancy,Sunday Bisi was appointed by the NWC on the recommendation of Osun PDP State Working Committee. This decision was also ratified by the NEC of the Party at the convention.
If you are a true, patriotic, committed and loyal member(s) of PDP,you ought to have known that the decision is sine die.
There is no point challenging the decision.
There is no court in the land that can meddle in the internal matter of the party again.
That is the import of the Supreme Court Judgement when it says "no court can intervene in internal mechanism of political parties"

Let me reiterate the fact that, the ward executives conducted by PDP in 215 wards out of 332 wards in Osun State in 2021 when Sunday Bisi is still the State Chairman, the 3 ad-hoc delegates in all the 332 wards of the state conducted last week by His Excellency Ahmadu Umaru Fintiri and his principles team that had been ratified by the NWC, and other statutory delegates are the only authentic delegates that will be allowed to vote for the PDP governorship candidate on 8th March,2022 at Osogbo City Stadium.
If you still hold on such untenable assumption of Soji Adagunodo's list, you are just wasting your time.
When the National Working Committee of PDP will be sending officials to conduct the party primaries from Abuja, would they send the team to your Anigba Group? You better go and borrow yourself brain and stop your grandstanding through cyber activism.

Let me also say this before concluding my response that ward congresses will be concluded in the remaining 112 wards remaining in Osun, I all 30 local governments and the State shortly after the governorship primary election to put the party on a sound footing in Osun State.

In conclusion,if Oloto 1 as he call himself is still having the misconception that Anigba Group with its arrowhead,Soji Adagunodo is still relevant in PDP Osun politics, you are all living in the past.
Your posterior masters from Oyo State cannot save you from this embarrassing reality you found yourself.

The way things are looking, na courts go settle this Osun PDP primary matter las las, because there'll likely be two different/factional governorship primaries that'll be held on that day. Such a development would only serve to weaken and distract the party from the main election.
