WHO CAN CALL THE NEC MEETING?

The next big question we need to answer is who is vested with the power to call for NEC meeting in the APC constitution?

Those without short memory would recall when the Oshiomole crisis raged. Then APC had only Oshiomole as National Chairman. No National Secretary and no Deputy Chairman South who would constitutionally taken over the party chairmanship according to APC constitution.

So when the Appeal Court sacked Oshiomole, Hilliard Etta, the then Deputy National Secretary, rightly argued that he was the next most ranking official to take over the party and rightly so, the party stakeholders agreed and he became APC Acting Chairman and in that capacity he called for the party’s NEC where Oshiomole’s sacking by the court was rectified and Buni appointed as Caretaker Chairman.

Now, by decision of APC NEC, the power to convene any other party NEC meeting now rested on Buni and Akpanudoedehe who was appointed secretary because the APC constitution clearly stated that only the party’s chairman or secretary can convene a NEC meeting.

The question now is, at what time did Sani Bello, the Niger State Governor, become an Acting Chairman of APC? Did Buni transfer power to him before traveling? If not, how did he assume the party chairmanship in acting capacity? If he is not legally an Acting Chairman, what constitutional standing does he have to convene a party NEC where Buni’s sack would be rectified? Because as of today, the only two people with the constitutional power to call for APC NEC is Buni and Akpanudoedehe. Anything convened by anyone else aside these two is not NEC but jamboree gathering with no locus standi.

Making Buni the APC Caretaker Chairman was an illegality in itself because Buni as an elected governor was constitutionally barred from holding any other executive position. Similarly does APC constitution bar any elected official from holding any position in its NWC. But APC ignored these two legally binding constitutional provisions and appointed Buni as Caretaker Chairman. Removing Buni through another illegal means and replacing him with just elected governor would dipping itself deeper into chains of illegalities that it cannot get out from.

If anything, the authentic National Chairman of APC as of today is Hillard Etta. Because the court order that pronounced him as that is yet to be vacated nor challenged. So, if APC does not want to cease to exist as a political party, it’s time they invited him to take over the party except they are sure they have the judiciary in their pocket.
