A Federal High Court in Lagos has sentenced the Group Managing Director of Skye Bank, Mr. Kehinde Durosinmi-Etti, to prison fordisobeying its order.
Durosinmi-Etti is also to payN5m and remain in jail “untilhe purges himself of contempt.”
Justice Charles Archibong delivered the judgment in a suit instituted by Desange Nigeria Limited, the judgment creditor.
Desange had secured a judgment against the Nigeria Customs Service in 2010, but the organisation refused to pay the judgment sum.
This forced Desange to file a motion to garnishee the accounts of the NCS in five banks.

It is obvious from the comments coming after the OP, that most of the readers do not understand a single bit of what was said but simply went straight to the reply button and proceeded to spit all the rubbish, which I'm sure arose out of the animalistic need to ignorantly attack any person perceived to be succesful and better than them.

It was reported that the NCS account with Skye is a collection account, meaning that at periodic intervals there is a sweep of the funds to the main account (which may not even be domiciled in Skye bank and so may be totally unconnected to the court case). So I don't feel the court can order the bank to pay a specific sum from the said collections account. Ok, supposing the balance in the NCS collections account was close to Zero at the time of carrying out the order? Where would the money have come from to pay the litigants? Where?

Well the Skye parties have the Appeal court to contest the judgement.

People should also think carefully before posting their comments so as not advertise their brazen ignorance and beclouded sense of judgement. You can google Ganishee order or check it up in wikipedia to see what it means.

Here is the statement given by the Bank


"Following spurious newspaper captions alleging stories of the GMD's arrest sequel to a court ruling by the Justice Archibong of the Federal High Court Lagos, please be informed that the GMD has neither been arrested nor is he in custody of any nature.

It has become imperative to correct the erroneous assumptions. THESE ARE THE FACTS

1.     Justice Archibong of the Federal High Court Lagos made a Garnishee Order Nisi against the account of Nigeria Customs with the Bank. An affidavit was filed stating that the Nigeria Customs has an account with us, but it is a Collection Account, and as such the balances in it belong to the Federal Government, and cannot be attached. The Bank also deposed to the fact that the account is a No Debit Account.


2.    In spite of this, the judge made the order absolute, ordering the Bank to pay the sum of N6m from the Federal Government’s money, knowing fully well that the Federal Government is not the judgment debtor, and the money does not belong to the judgment debtor - the Nigerian Customs Service.


3.    The judgment creditor’s lawyer, Olisa Agbakoba SAN also went ahead to file papers   for contempt proceedings against some principal officers of the Bank, including the GMD, and the Company Secretary. However, non  of the Bank’s principal officers including the GMD ever got the papers purportedly served.


4. In respect for the law, the Bank issued a draft for the payment of the money. However, a Notice of Appeal was also filed at the Court of   Appeal against the ruling of Justice Archibong. In addition, an application for an  injunction to restrain presentation or giving of value to the   cheque, in view of the grievous fact that the money in question does not belong to the  Nigerian Customs Service was also filed.


5. When the cheque came through from clearing, the Bank gave value to it under caution to the receiving  Bank, attaching the various applications that are pending at the Court of Appeal over the money. The Receiving Bank however returned the money to us pending when all the issues are resolved.


6. Olisa Agbakoba and Co. regardless of the instituted Case in the Court of Appeal went ahead to request a warrant of arrest against the GMD and other principal officers of the Bank which Justice Archibong went ahead to grant. Part of their allegation was that the Bank issued a dud cheque (which as detailed above is not the case).


7. The Bank’s lawyers appeared in court on behalf of the GMD and other principal officers of the Bank. They pointed out the fact that the irregularities of the committal processes are subject of  an appeal pending before the Court of Appeal. The judge however proceeded to take an application against the Bank behind our back, and behind the back of our lawyers, in clear violation of the principles of fair hearing enshrined in the Constitution.


8.    The judge went ahead to order the GMD’s arrest, or any other principal officer of the Bank if he could not be apprehended. He also ordered that the Bank must give value to the cheque, and awarded damages of N5m against Skye Bank.


9.    It is important to note that the judge does not have any jurisdiction to entertain this matter anymore, as the appeal has been entered at the Court of Appeal, a number issued and the case file transferred to the Court of Appeal.


10. The Bank stands by the provisions of the Sheriffs and Civil Process Act that stipulates that contempt proceedings cannot be instituted for failure to money judgments.

Please note that Legal redress  is being aggressively pursued to ensure justice prevails."

The fhc has the right to order payment from a government account ,what d md should have done wat to show evidence that there were no funds in the account to avoid contempt(jail time is 6 mths) and contrary to what the highly paid praise singer said appeal to the coa is and would never amount to a reversal of the fhcs order. For all ur criticsm of the others u know nothing of the law
