Go to which jail. In Nigeria justice is for sale and it goes to the highest bidder. He had been sentenced but has he appear physically there. All these are just mere joke. Which kind jail be dat.

Am yet to investigate the real details in this issue, but fom the reactions of people it is obvious that the public are angry with the banks because of the way they sacked their staffs in recent times, in which skye bank is also involved. The banks have lost their respect and perceived integrity.
Even those still working there cant be too sure of what happens next. These are the real issues i feel people are angry. Hakuna Matata

The fhc has the right to order payment from a government account ,what d md should have done wat to show evidence that there were no funds in the account to avoid contempt(jail time is 6 mths) and contrary to what the highly paid praise singer said appeal to the coa is and would never amount to a reversal of the fhcs order. For all your criticsm of the others u know nothing of the law

In relation to the above highlighted!
Q: Why is a case taken to an Appeal Court? Or "Appeals" in general?
A: When the defendant is not satisfied with the "judgement of a LOWER COURT".

Q: can a lower court overrule a higher court and what happens when a case is taken to a higher court
A: a lower court CANNOT overrule a higher court. When a case (an appeal) is made to a higher court, the lower court then, from that moment, "lacks jurisdiction" to entertain the matter! In other words, it must transfer the file "upwards" and wash its hands off that case.

Q: If the "lower" courts ruling was carried out irrespective of whether the case is "on Appeal" at a higher court and the higher court nullifies the judgement of the lower Court (say a Death Penalty!), do you think justice would have been served?

A: No, when a case goes to a "higher court", the judgement of the "lower court" goes through what is called a "Stay of execution Order".
The higher court can then re-affirm that earlier ruling or quash it, as it deems fit.

Applying the above principles to this case, the lower court judge has erred in law

Only God knows what some of these Nigerian judges are smoking nowadays! This matter is simple enough even for a young "baby judge"!

Until a case is finally determined, EVERYONE is deemed innocent and can therefore not serve a punishment for the same case.
The judge should have tarried a bit and see whether his judgement would be affirmed at the higher court, why rush to commit a man to prison?

What if the Bank has "paid" and the higher court reverses/quash the judgement, is the court now going to ask the "plaintiff" for reimbursement? or does it not make more sense that the judgement be "set-aside for the time being", pending final determination?

The case may as well go as high as the Supreme court, for all we know!
So, What exactly is the rush?

Just my Take on the issue, no vested interest in anyway!
