They gave an unbiased report and as a neutral body,their report carries weight.there is no way that thee court will base their judgment only on muoghalu's averments.that apc started primaries late means that indeed there was primaries
Their report leaked or (they leaked it) and Moghalu tendered it in Court but INEC didn't respond to it. INEC simply said it had nothing to say and will abide by whichever side the Court will take.

INEC have said repeatedly that their recommendations are usually in-house and not for the public. APC had only two arguments;
1. That logistics made them commence the election late, around 5:30pm or so.

2. That Moghalu didn't participate in the election hence had no locus to sue but Moghalu's argument was that since he didn't participate why did APC release a result that included his scores.

Ekwo's Judgement

“the real issue in this case, which both the first defendant (APC) and third defendant (Uba) seem not to understand is not whether accredited members of the first defendant voted on 26th June, 2021 but whether there was any primary election at all conducted in accordance with the mandatory provisions of both the Electoral Act (as amended) and first defendant’s Guidelines for the
Nomination of Candidates for the Anambra 2021 Gubernatorial Election-Direct Primaries (Option A4).


“When a primary election is illegal, the fact that such illegal election was monitored by the Nigeria Police (or other security agencies) as averred in paragraph 25 (ii) of the third defendant’s counter-affidavit is of no moment.

“The combination of the evidence, in this case, by both the first and third defendants has created doubt in me that gubernatorial primary election of the first defendant for the nomination of its candidate for the Anambra State Governorship held at all or was held in accordance with the provisions of the Act (as amended) and first defendant’s Guidelines for the Electoral Nomination of Candidates for the Anambra 2021 Gubernatorial Election Direct Primaries (Option A4).

“It is clear from the evidence in this case that the first defendant connived with the third defendant to conduct election outside the time prescribed by Articles 17 (vi) and 18(e), (g) and (i) of the first defendant’s Guidelines for the Nomination of Candidates for the Anambra 2021 Gubernatorial Election-Direct Primaries (Option A4) to the exclusion of the plaintiff.

“At the end, the votes in Exhibit MAM 9 of the third defendant were gratuitously awarded to other aspirants while the third defendant retained the highest votes. Now, the ingenuity of the first and third defendants has resulted in illegality and has backfired.

“In the end, it is my finding that the plaintiff has demonstrate upon preponderance of evidence that the gubernatorial primary election of the first defendant was not conducted in accordance with the provisions of sections 85 (2) and 87(1) of the Electoral Act 2010 (as amended) and Articles 17 (vi) and 18(e),(g) and (i) of first defendant’s Guidelines for the Nomination of Candidates for the Anambra 2021 Gubernatorial Election-Direct Primaries (Option A4).

“Therefore, the case of the plaintiff succeeds on the merit,”
the judge said.

It was indeed APC's guidelines that was used to fault it and not INEC's.

My laughter is informed by the fact that we were here telling Tinubu urchins that Andy Uba will never govern Anambra, but they believed in the fictitious result that Tinubu sent Dapo Dagboru to write for Andy Uba in the hope that when Andy wins, he will be one of the governors supporting his presidency bid.

Aside the hatred for APC in the southeast, the hatred for the Uba brothers in Anambra is unquantifiable and Uba himself is a dullard and a crook.

Same way we are telling Tinubu urchins that Tinubu will never be president but they keep foaming in the mouth instead of listening to voice of reason.

Your judgment over this matter, when it was first heard before you at the FHC Room 6, Abuja, was indeed a landmark decision & judgment. Little wonder, both the Court of Appeal and the Supreme Court, have no problem affirming Your Lordship's reasonings and your reasons for reasoning the way you did over the case. May God continue to elevate you, bless and protect you sir.
