A Nigerian man who was earlier charged for allegedly sexually assaulting a female customer while working as a sales consultant has been placed on probation.

Israel Okwuchukwu Onwuegbuzie, 23, a University of Prince Edward Island (UPEI) student from Nigeria, was originally scheduled to stand trial on the charge of sexual assault. Instead, on May 31 in provincial court in Charlottetown, Onwuegbuzie sat at the defence table next to his lawyer Isaac Quinn and pleaded guilty to the offence.

Reading from an agreed statement of facts, Crown attorney John Diamond said that on Saturday, Sept. 11, Onwuegbuzie was working as a sales consultant at Staples on University Avenue in Charlottetown. At around 9 a.m., a woman entered the store looking to buy a desk.
Onwuegbuzie spoke to the woman and said her lips were "really turning him on." The woman walked away and continued shopping in another aisle near the back of the store.

Onwuegbuzie followed her and put her hand on the crotch area on the outside of his pants. He then kissed her on the side of her face, neck and briefly on her lips, said Diamond.

The woman left the store and phoned the manager to complain about the encounter. Inside Staples, the woman was wearing her workplace uniform. Later that day at around 4:45 p.m., Onwuegbuzie showed up at her workplace – a local grocery store – and asked to see her.
Onwuegbuzie was recognized as the sales consultant from Staples and was asked by the store's manager to leave. He was arrested the following day on Sept. 12 for sexual assault.

Diamond presented a joint recommendation with Quinn for two years of probation and a conditional discharge. Diamond said he spoke with the female victim, and she was satisfied with the recommendation.

If Onwuegbuzie doesn't breach the conditions of his probation, he won't have a criminal conviction at the end of the two-year period.

Quinn told the court that his client is studying computer science at UPEI on a student visa and plans to graduate in the spring of 2024.

Quinn added that his client has a bright future ahead of him, and by pleading guilty, he spared the female victim from testifying at a trial.
Quinn noted that a conditional discharge was not contrary to public interest and a criminal conviction could lead to Onwuegbuzie being deported under the Immigration and Refugee Protection Act.

Chief Judge Jeff Lantz accepted the joint recommendation. He agreed that a conditional discharge was obviously in Onwuegbuzie's best interest.

The recommendation was also not contrary to public interest to have Onwuegbuzie finish his degree at UPEI and learn from the experience.

Lantz also summarized a victim impact statement filed with the court, saying that the woman quit her job as a result of the incident. She is also dealing with panic attacks and is fearful of being inside stores and near strangers.

During the two-year probation period, Onwuegbuzie is not allowed to have any contact with the victim. He is also required to take programs for sexual deviancy and/or respectful relationships.

Other aspects of the sentence require Onwuegbuzie to provide a sample of his DNA to the national databank and pay a $100 victim surcharge.

This one is a disgrace to Nigeria. Can you imagine assaulting a lady for what reason undecided the demons from his father’s house followed him to Canada.

Luckily, he is studying Comp Sci, so he should be able to get a job no matter how bad even if it is remote. Or get Canadian citizenship and head to Asian nations.
