In New York City, there are always construction projects going on. Employees should be aware that these are some of the riskiest areas to be on the job. If a construction worker is injured, they may submit a workers' compensation claim, just as they can in any other state in the country. Workers' compensation pays for medical expenses and a percentage of lost wages for employees.

Even though workers' compensation rules vary from state to state, they are mostly the same. On the other hand, New York has its own set of laws distinct from those in other states and is not covered by workers' compensation. A Syracuse construction accident lawyer describes each of them in more detail below.

Health And Safety Responsibilities For Employers

Employers are required to preserve the health and very well of their employees, among other things, in accordance with Section 200 of the National Labour Relations Act. Construction site contractors must take reasonable and necessary actions to guarantee that any work site is free of the dangers outlined in this article in order to be in compliance with the law.

Workplace injuries caused by a potentially hazardous situation may entitle the injured party to launch a lawsuit against the site's owner or the general contractor responsible for the accident. It is necessary for workers to show that the property owner or contractor was informed of, or should be aware of, a dangerous condition on the premises.

Law Of The Scaffold

Scaffolding, which is used to support employees on building sites, is a common yet potentially hazardous piece of equipment to observe on construction sites. When working at a height, construction workers are compelled to utilise protective structures to keep themselves and their equipment safe from falling objects.

Because of improper installation, the guardrails and scaffolding may fail and cause the building to which they are attached to collapse. According to Section 240 of the Labour Legislation, several restrictions are in place to safeguard the safety of construction employees while on the working site. If building site owners and general contractors fail to comply with the scaffolding requirements, they will be held liable under this law.

Legal Action Against Contractors

Section 241(6) of the Labour Code regulates the employment of construction, demolition, and excavation workers. Construction workers in New York can file a lawsuit against their employers if they violate specified articles of the state's Industrial Code. It is hazardous for contractors and site owners to be working on slick surfaces such as sidewalks, floors, tunnels, platforms, or scaffolding because of the potential for slippage.

Who Is Protected Under New York's Labour Law?

This kind of law does not apply just to construction employees. It's also vital for those whose jobs require them to visit building sites regularly to get this kind of insurance. This Act applies to all calls for firefighters and police officers directly related to their respective occupations.
In the case of a building site, a firefighter may be sent to inspect the structure's capacity and weight constraints. The law intends to preserve the right to sue the person accountable for their injuries if they are sustained due to the carelessness of property owners or contractors.

CONTACT A WORKPLACE ACCIDENT ATTORNEY

If you or a loved one has been hurt at work, a New York workplace accident attorney may be able to assist you. You will need an expert attorney on your side to get the total compensation you are entitled to.

There is nothing spectacular from the NY law, we called it safety law in Nigeria. The only difference is that there is no proper implementation in Nigeria aside Lagos State and some sectors.
