The fate of Nigerian Osaivbie Ekogiawe has been causing a stir in Würzburg for days. Although he is well integrated and, for example, has finished school and started training as a social worker, he should be deported tomorrow, Tuesday. The administrative court in Würzburg put a stop to this on Monday. Ekogiawe cannot be deported until a decision has been taken on his residence permit. The Nigerian applied for his residence permit at the end of June.

At that time he still had a Duldung. The immigration authorities withdrew it from him after he had handed in his passport. This also expired the basis for issuing a residence permit. The central foreigners authority of the government of Lower Franconia is responsible for the procedure.

For days, many people had shown solidarity with him. Last week there were protests in front of the Würzburg district court. On Monday, around 130 people demonstrated in downtown Würzburg to stop the deportations. Around 3,700 people signed an online petition on Monday afternoon

Osaivbie fulfills key requirements: he came to Germany as a minor at the age of 16. He has been living here for more than four years and has had a toleration status throughout. He is still an adolescent, i.e. under 21 years old. He graduated from high school here in the summer of 2021 and started his nursing training in September 2022.

But instead of supporting him and using the opportunity to issue him a residence permit in accordance with Section 25a of the Residence Act, the immigration authorities have remained inactive to this day. So it was possible to revoke his toleration in the meantime and this is now the reason for the deportation.
