Contrary to the lawyer's, I don't think Davido's conduct breached any aspect of criminal nor tort law. It is not an offence to hold a child while in the pool. Regarding civil wrong, if Davido's nanny is a certified carer, then the nanny by virtue of her profession owed a duty of care to Ifeanyi because it is foreseeable that leaving the boy under the care of a non carer might put him in danger. On the part of the nanny and criminal law, INTENT must be considered seriously here given that she went to answer a call. Who called her? Is the caller known to the family and reasons? It has be proven beyond reasonable doubt. |
