The West African Examinations Council has confirmed before the High Court of the Federal Capital Territory in Bwari, Abuja that the candidate of the Peoples Democratic Party for the governorship election scheduled to hold on Saturday in Osun State, Ademola Adeleke, sat for its examination in 1981.

WAEC stated this in a court filing which it made in compliance with an order issued by Justice Othman Musa on September 11.

In the results attached to the documents filed by WAEC, Adeleke was listed as number 149 out of the 221 candidates that sat for the May/June 1981 examinations of the Council at Ede Muslim High School in Ede, Osun State.

The results showed that he sat for only English Language in which he had F9.

He did not sit for other registered subjects which included Mathematics, Literature in English, Islamic Knowledge and Geography.

He also did not sit for Economics and Biology.

Justice had directed WAEC to produce Adeleke’s results in a ruling on an ex parte application by two plaintiffs, Mr. Wahab Raheem and Mr. Adam Habeeb.

Justice Musa had in the ruling specifically ordered the examination body to produce in court the ledger containing results of Ademola and his mates with whom he sat for the examinations.

He also ordered WAEC to swear to an affidavit either denying or confirming that Adeleke, an incumbent senator representing Osun West Senatorial District in the Senate, sat for the Council’s May/June 1981 examinations conducted by the Council at Ede Muslim High School in Ede, Osun State.

The court ordered that WAEC should file the ledger and the verifying affidavits within five days of being served with the enrolled order.

The court also ordered both the Peoples Democratic Party and the Independent National Electoral Commission to show cause within five days from the day of service of the originating summons” why they should not be stopped from recognising Adeleke’s candidacy.

Adeleke who is the candidate of the PDP in the governorship poll has been accused of forging his WAEC certificate.

But the Senator has since denied the allegation which he said was a lie being peddled by his political detractors.

However, in an affidavit deposed to by the Deputy Registrar/Head of School Examination Department, WAEC, Henry Sunday Adewunmi Osindeinde, and filed in response to the court’s September 11 ruling, the examination body confirmed that Adeleke sat for the May/June 1981 at Ede Muslim High School, Yidi Road, Ede.

Osideinde stated that the examination centre number was 19645 while Adeleke’s number as a candidate in the centre was 149.

WAEC attached a copy of the results of all 221 candidates that sat for the May/June 1981 in the centre at Ede Muslim High School.

Osindeinde said in the affidavit that: “By virtue of my position as Deputy Registrar/Head of School Examination Department, I have read the enrolled order of this court (specifically orders iv, v and vi) dated 11th September 2018 directing and compelling the WAEC to depose to an affidavit confirming or denying the said orders contained in the said enrolled order and referred to in this paragraph And I wish to state as follows:

“The said candidate named in this suit known as Adeleke Ademola, with Centre Number 19645 and Candidate Number 149, indeed sat for the Senior Secondary School Certificate Examination in May/June 1981 conducted by the council at Ede Muslim High School situate at P. O. Box 6 Yidi Road, Ede, State of Osun.


“The copy of the result listing referred to by the court order as the ledger containing the results of all the candidates (001 – 221) who sat for the Senior Secondary School Certificate Examination in the said school is hereby certified, attached and marked: Exhibit WA1.”

Adeleke has yet to file any response to the case.

The plaintiffs’ had contended in the suit that Adeleke’s claim that he sat for the Senior Secondary School Certificate Examination in May/June 1981 could not be true because Secondary School Certificate Examination had not been introduced then.

They argued that what was in existence then was the West African School Certificate Examination.

Justice Musa had fixed Wednesday for hearing in the case, but the court did not sit as the judge was said to be away on an official assignment.

The plaintiffs’ lawyer, Bankole Komolafe and the counsel for Adeleke, Nathaniel Oke, SAN, mutually agreed with court officials that the matter be adjourned till September 25.

Appeal Court clears Adeleke of certificate forgery in Osun State guber polls

The Abuja Division of the Court of Appeal has dismissed the ruling of a Federal Capital Territory (FCT) High Court sitting in Bwari Area Council which nullified the candidacy of Senator Ademola Adeleke of the Peoples Democratic Party (PDP) in the September 22, 2018 Osun State governorship election.

Justice Emmanuel Agim, who read the judgment, held that the defendant’s West African Examination Council (WAEC) certificate was not forged, adding that the testimony of the official from the organisation was also valid.He stated that the suit was statute-barred and that the judgment delivered in 209 days by Justice Othman Musa ran foul of the constitutionally stipulated 180 days for adjudication on pre-election matters.

The Abuja court had on April 4 disqualified Adeleke from participating in the polls on the ground that he did not possess the requisite qualification. In the unanimous judgment delivered yesterday, the appellate court also held that the suit filed by members of the All Progressives Congress (APC) challenging Adeleke’s qualification was a pre-election matter brought outside the 14 days allowed by law.

Justice Agim equally held that being a pre-election matter, the suit ought not to have been filed 43 days after the appellant submitted the alleged forged WAEC certificate.He therefore resolved all five issues raised by Adeleke in his favour.

On the issue of jurisdiction, the judge submitted that the FCT court had no jurisdiction to have entertained the suit whose cause of action arose from Osogbo where Adeleke submitted the alleged forged document.Furthermore, he said it was curious that the trial court also subpoenaed some evidence and exhibits like the affidavit from WAEC yet failed to consider them in its judgment.

Certificate Scandal: Adeleke qualified to contest Osun Gov Election, says A’Court

upholds his nomination, awards N3m cost against 2 APC Chieftains

ABUJA – The Court of Appeal sitting in Abuja, on Thursday, said it was satisfied that Senator Ademola Adeleke of the Peoples Democratic Party, PDP, possessed the requisite educational qualification to contest the last Governorship Election in Osun State.

The appellate court, in a unanimous decision by a three-man panel of Justices, nullified as “perverse”, the judgment of an Abuja High Court in Bwari, which voided Adeleke’s nomination on the premise that he used forged WAEC Certificate and secured clearance to participate in the Osun gubernatorial election that held on September 22, 2018.


Two Chieftains of the All Progressives Congress, APC, Wahab Raheem and Adam Habeeb, had in a suit they filed before the election was conducted, alleged that Adeleke made false declarations in the Form CF001, he submitted to the Independent National Electoral Commission, INEC.

The Plaintiffs, through their lawyer, Mr. Bankole Akomolafe, alleged that contrary to what was submitted to INEC, Adeleke, did not sit for WAEC examination in 1981 as he claimed, since there was nothing like the Senior Secondary School Certificate Examination as at then.
Besides, the duo maintained that NECO examination that Adeleke claimed he sat for could not be genuine, considering that the body was not in existence as at the time the Defendant said he sat for the examination.


Following the suit, the high court, in a judgement delivered by Justice Othman Musa on April 2, held that Adeleke who is currently representing Osun West Senatorial District, lacked the minimum educational qualification prescribed in section 177 of the 1999 Constitution, as amended.


The court noted that the section stipulated that candidates vying for governorship position must be educated up the secondary school level.

Justice Musa stressed that whereas the court found that Adeleke entered secondary school in 1976, he said there was no record to show that the PDP’s flag- bearer actually graduated as his name was not found in the school’s register from 1980.

The court held that the result Adeleke attached to the form CF001 he used to secure clearance from INEC, was fake.

It stressed that the result was found to be different from the one that was presented to the court by the principal of Ede Muslim High School, Ede, Osun State, where Adeleke purportedly graduated from.

Consequently, the court held that his nomination to participate in the September 22, 2018, governorship election was bound to be nullified.

However, the high court verdict was on Thursday, dismissed for being perverse and in contradictory to documentary and oral evidence that was adduced by both the parties and witnesses.

The appellate court, in a lead Judgement by Justice Emmanuel Agim, held that the trial denied Adeleke fair hearing by deliberately refusing to properly evaluate and consider all the evidence that showed that he attended Ede Muslim Grammar School Ede and sat for WASC in 1981.

It noted that the trial court insisted that Adeleke did not complete his secondary education, despite the testimony of the School Principal as well as the Deputy Registrar of WAEC that testified and tendered evidence during hearing on the matter.

The appellate court further observed that owing to an application by the Plaintiffs, the court summoned the WAEC boss who deposed an affidavit and also tendered a ledger that indicated that in the exam it conducted in May/June 1981, Adeleke, was candidate number 149, with his center number as 19645.

It also noted that the examination body submitted document that contained the result of all candidates (001-221) that sat for Exam in the school, with Adeleke’s result showing that while F9 was recorded for him in English language, the other subjects were withheld.

The appellate court held that conclusion of the high court that Adeleke dropped out of school was not supported by any evidence that was brought before the court.

“If he had dropped out of school, he would not have sat for WAEC in 1981”, Justice Agim added.

Relying on several Supreme Court decisions, the appellate court held that as far as Adeleke educational pursuit was up to the School Leaving level, it did not matter whether he passed the examination or not.

Besides, it held that Justice Othman was wrong when he assumes jurisdiction and voided Adeleke’s nomination, based on issues that were previously resolved on August 8 by a High Court in Oshogbo.

It held that the Abuja court, including the plaintiffs, were estopped from querying Adeleke’s educational qualification, since a court of same coordinate jurisdiction had delivered judgment on it.

More so, the appellate court held that the substantive suit was ab-initio defective, stressing that it has become status barred since it was filed outside the mandatory 14 days section 285(9) of the Constitution provided for pre-election matters.

It held that any suit that sought to disqualify a candidate under section 31(5) of the Electoral Act, amounted to a pre-election matter in which judgment must be delivered in writing within 180 days.

In the instant case, it noted whereas the plaintiffs lodged their case over 43 days after Adeleke’s name was submitted to INEC, the trial court on its part, delivered its judgment 209 days from September 4 when the case was filed.

“The judgement haven been delivered out of time is void”, the appellate court held.

While upholding all issues Adeleke raised in his appeal, the appellate court, said it was satisfied that he met all the requirements stipulated by section 177(d) of the 1999 Constitution, as amended, and was therefore qualified to contest the Osun Governorship election.

The court invoked its powers and struck out the substantive suit that led to Adeleke’s disqualification, even as it awarded a cost of N3million against the two APC Chieftains.

It will be recalled that the Osun State Governorship Election Petition Tribunal had in a two-to-one split judgment on March 22, declared Adeleke as the valid winner of the gubernatorial contest.

Judgement of the tribunal was on March 9, upturned by the appellate court, which affirmed the victory of Governor Adegboyega Oyetola of who was candidate of the APC in the election.

WAEC Clears Davido’s Uncle, Adeleke Of Certificate Forgery

The West African Examinations Council, WAEC, has cleared Senator Ademola Adeleke, a governorship candidate of certificate forgery brought against him by two chieftains of the All Progressive Congress, APC.


The council in an affidavit deposed to by one Osindeinde Adewumi and filed at the registry of the FCT high court, Senator Adeleke was confirmed to have sat for the senior secondary certificate examination in May/June, 1981.

The affidavit was filed in compliance with the order of Justice Othman Musa asking WAEC to supply the court with the result. WAEC confirmed that Senator Adeleke with candidate number 149 and center no 19645 sat for the exam at Ede Muslim high school, situated at Yidi road, Ede in Osun state .

And the certified true copy of the ledger indicated that senator Adeleke who is currently representing Osun west senatorial district in the senate sat for only English language in the examination.


Wahaab Raheem and Adam Habeeb of Apc had approached an Abuja high court asking it to disqualify Adeleke from participating in the September 22 governorship election in Osun state on the ground that he does not have the required qualification.

The two in their application claimed that the PDP candidate did not sit for the WAEC examination in 1981 because the senior secondary school certificate had not been introduced by 1981.

Meanwhile Senator Adeleke on Monday said he missed the debate organized for candidates because his campaign train was held up in a village where his supporters didn’t allow him to leave as scheduled.

Adekeke who spoke through the Director of Media and Publicity of his campaign organization, Malam Olawale Rasheed said he planed to attend the debate but he missed it unavoidably.


“According to him, the plan was to proceed to Osogbo immediately after the campaign tour of Ijesha and Ile Ife zones. We communicated as much to the organizers of the debate”.

“However, from one village to the other, rural voters blocked the campaign train and we were held up. From Ilesa zone to Ile Ife zone, the rural visitation dragged late into the night. It would have been politically suicidal to ignore those people in the villages.”

I am not one of his supporters, because he does carry himself well in public with his dancing stuff and hand gesture to the face, but what has scoring F9 in English got to do with governance.

Minimum qualification for political post in Nigeria is SSCE certificate and the law never says you must score A1or C6 in any subjects to govern.

At least the dancing Jackson can express himself in English and his local language.
