Ur intentions now(Gazzuz) just explained the circled part of ur msg.
Normally the seller no fit understand as he might just feel,u paid for it,whereas u actually meant if he saw a better offer from his end,he should sell and forward accrued profit over to u since u paid for it already
Seller was still thinking,the transaction was still open and u felt u already closed transaction.
But still let’s learn how we use the word SCAM,it does more damage than good when at the end we realize that it wasn’t really a scam situation.

If it happens to me, I will trust him more for returning my money and will want to do more business with him in the future while at the same time reminding him of our past business so that he will make amends....

If the seller ran away with his money, that will be fraud....

There's something called Fair Market Value and i read the entirety of this thread only to see no one mentioned it.

Fair Market Value is the cost of a commodity when there is no pressure to buy or sell.

It's the price of a goods where no party is leveraging on the weakness of the other to make a sale.

I don't think N400K for a N700K TV is fair market value. That's almost twice the amount the TV is worth on the open market.

I would have been on Gazuzz side if he paid the 450k the seller originally wanted.

That N50k was the bone of contention and cause of this thread.

Biosilicon could have come up with so many reasons to refund Gazuzz his money but intentionally wanted Gazuzz to know he sold it to someone else .

The seller was more wrong than the buyer but both parties did not come in equity.

Consequently, there are no clean hands here.

Before selling the TV, the full risk was on the seller.

He was selling the TV with the full knowledge that it was going to be resold. He needed quick cash and wasn't sure he could sell at a higher price even if he waited. He acknowledged others coming to him were offering the same 400k. He also acknowledged the fact that the buyer had a wider customer base and it was going to be 'easier' for him to resell, might just take time, which was what the seller didn't have luxury of.

Seller agreed to the 400k after negotiations, which the buyer sent, and at that point the seller transferred the risk to be buyer.

……

I rest my case.

Risk is only transferred to the buyer when goods is transferred to the buyer not when payment is made that is the general business standard.

What the seller did is just bad business ethics … you guys are over analyzing this thing abeg.

He did not deposit.

He paid the full price.

That makes it his property. Not yours.

Wether he has taken delivery or not is immaterial.

Even at auctions, as soon as bidding closes, highest bidder wins.

Item cannot be issued to another bidder who came from the back with a higher offer.

It is not done.

Imagine if you had issued him a receipt with the serial number and all but he doesn't take the item and you go ahead to resell same item?

Learn from this and move on.

This is not how to do business at all.

Trust is a strong point in business.

You broke an agreement hence his trust.

This is not good at all, if price was agreed by both parties and seller sent account details and acknowledged receipt of funds then item now belongs to the new owner as price has been paid.

Seller sold another man's property without consent and that is as good as fraud, it is criminal.
Gazzuzz this chat is all the evidence you need to settle this matter anywhere you wish.

Vehicle and funds where with me till delivery on the 3rd of March, there where "better offers" but integrity is the reason we are still in business.

you raised valid points. However, I must ask, was the seller forced to collect the 400k? There was no vitiating element here i.e. no fraud, no undue influence, no duress and misrepresentation to warrant the seller refunding the buyer after offer, acceptance and consideration. There was only a breach of contract on the part of the seller.

Gazzuz case is similar to mine. Maybe learn one or two things from my experience.

I was heading to my day hustle when I made a stop at a warehouse selling used London items. A cream leather lazyboy settee was on display and I inquired of the price. I bargained to pay 400k for the chairs and made instant deposit of 350k to pick up later with the balance.

Few days later one of the sales person kept bugging me to come pick my seat. I was issues an invoice so I relaxed. The sales lady kept calling and I forwarded the balance to her but she insisted it was not about the money but for me to come free up their space unknown to me that's was when another customer has offered more. So it was just a good salesgirl notifying me of the impeding disappointment without breaching company policy.

I was startled the day she called and said I should come collect my money in full and return their invoice that the company owner is no longer interested in selling and that the seat has been moved to her house for personal use. I went there and seat was gone!

I quickly reported at the state CID and got some police officers from the state police headquarters and sealed the warehouse. Few hours the owner of the warehouse, a female practicing lawyer based in the UK sent in her Nigeria legal representative to handle me and make sure I was dealt with for locking her business without authorization from the court of law.

Police seeing the infractions and the impending legal catastrophe, abandoned me to make a soft landing for themselves. They even went against me in the presence of the business owner lawyer. I placed a call to a DIG in Abuja and the man candid advice was that if the seats are still there, that's if I could still sight the seat then I have a case but if not no need wasting my time and resources. As long as my money is REFUNDED in full, I have no case.

Pay and take posession immediately.

This issue of integrity reminds me of a deal I once had with a ‘middleman’. I needed funds about a year ago and I was ready to sell a foreign used(clean titled) 2012 Toyota Corolla Sport for 4m. The ‘supposed’ buyer started pleading, that all he had is his account was 3.6m… He pleaded and pleaded, until I told him to pay. He suddenly showed up with someone, who I later realized, was the ‘real buyer’. The ‘real buyer’ was begging me to sell at 4.3m and I was dumbfounded. Apparently, I realized that the middleman told him I was selling for 4.5m last. I looked at the middleman and and he winked at me. Later on, the buyer paid 4.3m and they both left with the car.
The next day, the middleman called and demanded that I send ‘his’ 700k to him. I did this without thinking about the fact that even I, didn’t make that much profit from the sale of that car. This is how a business man should operate with integrity. So many cases where one ends up choosing ‘integrity’ over ‘greed’.
