Who Should Buy New Pumping Machine In A House The Landlord Isn't Occupying?

Good evening nairalanders. The pumping machine of my rented apartment spoiled since Monday 16th of January. We v informed the landlord to come and help us buy another one cos it can't be fixed. He told us to contribute money to buy it. Are we going to remove it when we are moving out of the house?
This is a house that we v paid for agreement fee, damages and maintenance fee. He also told us that the water we are using has been added to our house rent cos I complained the fee is too high. He said shebi we know his house has borehole.
Pls I need honest advise cos I plan to make him see sense why he need to fix it.

He said the right thing, contribute money and buy it. You don't expect the landlord to help fix things like that. Moreover the landlord isn't living with you all...

When all the tenants contribute money to buy it, I guess they will be careful how they make use of it.

The tenants should replace the borehole pump. It was working when you'll moved in

He said this can't be fixed

Only option is to buy a new one plus they paid maimtaince fee

Well it depends on what the agreement says, for real tenants should fix it cos you are the one using it and by so doing you will be very careful In handling it.

Some people are so used to slavery that everything in life must be like slavery or its semblance.

Lemme ask a question. Do tenants go to pumping machine to damage it or the machines are damaged due to wear and tear during usage?

If the latter is the case, which always is, doesnt the basic tenancy agreement provide that tenant will cater to all that is within his premises?

Some Nigerians and slavery are like 5 n 6.

Your house was let to you at a price, bearing in mind you have access to water. What’s possible is that you have to pay for the meter units to pump water. If your pumping machine is automatic, it means that it pumps as water depletes. You don’t even need to go and touch it let alone damage it.


So if it spoils, how then is it up to the tenants to fix if they did not damage it by themselves?
When they leave, do they take it along and replace the house with the faulty one? And even if they do, won’t the landlord replace it before he brings in new tenants or he will ask new tenants to buy pumping machine before they move in?


Guys, let’s be real. Like the compound security gates, there pumping machine is a capital project which when it goes bad, Shld be replaced by the landlord of the property. So if the security gate falls/damages, tenants should fix it because they use it out because they are the ones who will be secured by the gate not the landlord? That’s shallow thinking which isn’t tenable in any court.

What is ideal is that the landlord is to be informed about the damage and invited to make the necessary repairs promptly (that should have been contained in the agreement so it’s not debatable) but in TVs likely even the landlord cannot fix it immediately due to urgency for tenants and landlord’s paucity of funds, it is possible, but must be agreed by both parties that, the tenants can bear the cost of fixing it either using the landlord’s workman or another workman (better to use the landlord’s but it doesn’t matter), and the cost to be borne by the tenants, but is passed onto the landlord who may reimburse at a later time or deduct from the next rent.

Just because it’s communal living and when the cost is divided by the number of tenants it may amount to less than 10k per flat, and you think 10k is very infinitesimal to you, you think it’s your responsibility to fix it, welldone.

When the house fence falls, fix it cos it’s you living in there not the landlord.
When the borehole falls, fix it, cos it’s you living in there not the landlord.

If you like don’t learn your rights as a tenant and understand your obligations as a landlord.

Just because you’ve been used to intimidation doesn’t legalize intimidation.

Only a stupid landlord will threaten to eject a prompt paying tenant because of refusal to contribute to fix pumping machine.

It’s not difficult to pay first year rent for new tenants but na subsequent years payment be the koko. So asa landlord, it’s better to keep up with your tenant and do your role than to keep turning over ppl in your apartment and doing frequent renovation for new tenants all cos you ejected sitting tenant for refusal to contribute to fixing/replacement of pumping machine.
