If the Electoral Act is anything to go by, Adeleke stands a very good chance of finding his way back to the governor's office in Oshogbo.

And why are PDP too stupid to use same?. It's strategy and PDP shouldn't be making noise about it. They should counter them too

Section 51 of the Electoral Act says that where the votes recorded at a polling unit exceeds the number of registered voters, then the inec state REC has two options:

1. He can order for fresh elections to be conducted in the affected polling units; or

2 He can decide that the incident of over voting was not significant enough to affect the integrity of electoral process and give the go ahead for tabulation of final results.

There's nothing in Section 51 which gives INEC the power or authority to just disregard the Electoral Act and issue Certificate of Return to a candidate on the basis of a court order.

This issue is so simple and uncomplicated. If APC is not shamed at the Court of Appeal, then it will mean that the rule of law no longer exists in Nigeria.
