* The supreme court has the power to declare an impeachment process illegal, not reinstate the president.


The president is not binded by ANY ruling by the court as the powers that be are mainly vested in the executive (president).

Regarding your last paragraph, the only judgment/ decision of the supreme court that the President of Nigeria has power over is in relation to criminal offences and not civil cases.

Precisely, the only judgment of the Supreme Court that the President may not honour is a judgment punishing a person for an offence. The President's prerogative of mercy vested on him by section 175 of the CFRN 1999 gives him power to pardon convicts after consultation with the council of state.

Apart from that, the President is bound by all rulings of the Supreme Court.

For clarity’s sake; all over the world, a president can invoke emergency powers and veto all acts of both judiciary and legislature. Also, by citing NATIONAL SECURITY, what the courts say no longer matter to the executive worldwide.

Legal action on monetary policies from CBN must begin at the high court and proceed higher if necessary.

A case on a monetary policy cannot begin at the supreme court. That's abuse of court proceeding.


Your opinion. Let the SC decide on feb 22nd.

There's nothing like the "practical power" of the executive.

All arms of government, including the executive, derive their powers from the Constitution of the Federal Republic of Nigeria. They are bound by it.

The President is either exercising Presidential power or abusing his office as president. The latter is wrong and constitutes an impeachable offence. In the current case, the president is abusing his office. Trump didn't go this low before his first impeachment was concluded. In a proactive democracy, the National Assembly would be sitting to begin his impeachment process today.

There's a reason the first thing coup plotters who take over power do is to suspend the constitution. As long as the constitution subsists, there's nothing like "practical power". It's either a president's constitutional power or abuse of power.

There is something like practical power of the president because the supreme court cannot enforce its own orders.

The same constitution empowers the president to give an executive order and even veto the legislature and judiciary, though in very outstanding cases. Trump's case is not comparable. Nothing the president has done thus far is unconstitutional.

The case at the supreme court is a charade.
