A lot of arguments are currently raging online on if the president's executive order should supercede a supreme court ruling.

This are few points to note, which are sacrosanct.

● The president is the number one citizen in the land and his directives are final.

● From above, a president's executive order can only be revoked by the president himself.

● From above, a president's executive order may be deemed unconstitutional, but in very rare cases.

● A president's executive order is hardly deemed unconstitutional because executive orders do pass through legislature for checking.

● From above, a president can decide to veto the legislature and give an executive order nonetheless, if deemed crucial.

● The three arms of government are equal truly, but the powers that be are lodged mainly in the executive (president).

● From above, the president is not under the judiciary and can overrule ANY ruling from the supreme court in a critical situation.

● The president who is also the overall head of the Nigerian armed forces can effect the immediate arrest of ANY governor in Nigeria. Though situations like this hardly arise.


Nigerians need to understand that there are no binding powers on the president of the federal republic. The president only has the "obligation" to respect the court orders. It is not binding on him. A presidential executive order supercedes any order in the land.

Legal action on monetary policies from CBN must begin at the high court and proceed higher if necessary.

A case on a monetary policy cannot begin at the supreme court. That's abuse of court proceeding.

APC created a policy, APC kept quite, APC accepted the policy, then APC gave deadline that was when APC saw the the error in the policy because APC now sees it as a threat to them buying vote.
APC now crying wolf.
APC now saying it is defending the masses against APC all of a sudden after almost 8years.
APC didn't defend the masses at a time SARS were killing them.
APC didn't defend the masses when ASUU was on strike.
APC didn't defend the masses when there was lockdown infact they even hoard palliative.
APC didn't defend the masses during fuel scarcity.
APC didn't defend the masses while bandits, herdsmen were running riots on both resident and farmers.
APC didn't defend the masses when we had multiple recession.
What a time to be alive, APC now care about you and me, all of a sudden hailers are now wailers. Is God not a miracle worker?

All the President 's powers come from the constitution.

That same constitution gives the Supreme Court the FINAL say on the legality or illegality of a President's orders or actions.

Any order given by the Supreme Court overrides that of the President, and even if the President disagrees with the order, he must first obey it, and if he wants the Supreme Court to change its order, the President will send the Attorney General to go and PLEAD with the Court to change the order.

Anything, everything, human or otherwise within the territory of Nigeria must obey the order of the Supreme Court.

Yes, the President is the most powerful person in Nigeria, but the Supreme Court is the single most powerful institution in Nigeria.

I am not against the policy. But why when did Buhari start making monetary policy pronouncement? What happened to all the new notes CBN governor said it was released daily to banks? What happened Why not the redesigned currency? What i do know is that the implementation has failed and they are not confused about the situation that is coming ontop their heads. Buhari is in Ethiopia licking ass, emefiele go hear shege...

The supreme court of Nigeria has the power to declare an executive order null and void.

The Supreme Court has the power to say that a man can marry a man and a man can change into a woman. It has happened in many democratic countries.

The supreme court has the power to say that abortion is legal or illegal against the order of the president or laws enacted by the legislature and heavens will not fall. It happened in America last year.

If an election petition from the court of appeal gets to the Supreme Court, the supreme court has power to declare the seat of the president vacant because he was invalidly elected. Any immunity he has will cease and will be ferried away from the office by the army if he resists.

The Supreme Court has the power of reinstating a president who is impeached and removed.

The Supreme Court has the power of declaring a law made by the National Assembly null and void and unconstitutional.

After the Supreme Court, you go to God.

The only abuse of power and unconstitutional actions are the actions of President Buhari.

The good news is that, the governors enjoy the same immunity he has.

Then there's a failure in the implementation along the line. Fact is that Emefiele lied all along to Nigerians and now they cant control the effect of the lies cos Nigerians have now had enough. Why are majority banks/atm closed and Cbn is saying anything? Where are new note given to banks daily by emefiele cbn? Why using a faild policy implementation to enforce 'cashless' transactions? Honestly the goofed and now chaos is arising

In every serious democracy including the USA, a President cannot veto an order of the Supreme Court.

It's the same in the UK, Germany, France, Canada, South Africa etc. Even Ghana!

And this is not a case of a banana republic. It is based on urgency of situation. In urgent situations the president can overrule anything.
