On the 2023 Presidential Election

The Election Courts in Nigeria were open to hear election related cases since February 18, 2023 as required by Nigeria's constitution, specifically Section 285 of Nigeria's constitution. This was confirmed by PremiumTimes before the presidential election on Feb 25.

Section 130 of the Electoral Act also stipulates that you can challenge both the conduct of the election itself, and the winner of the election process.

Since the presidential election has been conducted and winners have started being announced, I think the political parties can go to court immediately and challenge the process and the winners as stipulated by section 130, though this is has not been the norm.

Heck, I think you can even challenge the process before it starts, if you have evidence that it has been compromised, that's why the courts were open to hear cases before the election itself was conducted.

You don't need to wait for someone to be announced president to challenge the process. The more you wait, the more you lose leverage, because once an overall winner is announced, the government will like to move forward with handover.

Winners have been announced in many states already, so you can use evidence of rigging from a state to buttress your point and stop the process to investigate the rest of the election which happened on the same day.

Did INEC break the stipulations of the constitution and the Electoral Act? If you have evidence of that, you can go to court and nullify the process.
