Doesn't apply again- 7 days have passed and the certificate wasn't withdrawn. By the way, Olanipekun said this in Ekiti on the 18th of January 2023, the op deliberately made it look like he just said it!

The section 65(c) as signed into law by President Muhammadu Buhari last year states that, ” declaration of scores of candidates and the return of a candidate : Provided that the Commission shall have the power within seven days to review the declaration and return where the Commission determines that the said declaration and return was not made voluntarily or was made contrary to the provisions of the law, regulations and guidelines, and manual for the election.

Exactly, the OP cleverly did that. grin

I concur with you sir, but we bear in mind there might arise a situation where a returning officer is coerced or his/her life threatened, he/she can cave in to save his/her life then later do the needful,

The seven days for that don pass na

Why dangerous?
It's called Independent national electoral commission though we know it's not independent

If you have a tight case, which you need to escape from, hire him and give 3days and 3 nights to make necessary studies. After that, if he assures you you have a case, just go and sleep and watch him do his thing.

"...was made contrary to the provisions of the law, regulations, guidelines, and manual for the election.”

The REGULATIONS AND GUIDELINES the INEC Chairman, Prof Yakubu Mahmood, declared before the election was that election results would be transmitted directly from the BIVAS to INEC iREV on real time for public viewing of the progress of the election.

But the INEC Chairman deviated from the REGULATIONS AND GUIDELINES as election results were not transmitted from the BVAS on real time, but he declared a winner when the public could not access the results from the INEC portal.
That must invalidate the election and results produced therefrom.

He is right . It is a very dangerous thing to have in our electoral act . People should not see this with sentiments . This can destroy a country . Let’s say Obi won and he was returned then Tinubu gives the inec chairman 1 billion dollars and kidnaps his kids to change the declaration and he does . The violence , and possibly war , that will start immediately would be mad .
Re: INEC’s Power To Return Candidate Dangerous — Wole Olanipekun by Boyooosa(m): 5:45pm On Mar 14, 2023
Sometimes, I still don't understand how lame man like me will interprete law and acts l, more accurately, even than the so called legal luminary and SANs.....

The act states that:

Provided that the commission shall have the power within seven days to review the declaration and return where the commission determines that the said declaration and return was not made voluntarily or was made contrary to the provisions of the law, regulations, guidelines, and manual for the election.”

Two key words;
1. Not made voluntarily
2. Made contrary to the provision of law

My question is, which of the two points are meant to be good reason to declare a return of certificate?

It is by default faulty, to declare a winner or return of a winner involuntarily....the declaration must come under a voluntary will of diligence. Why should it come under duress, it must be done with conviction after all processes duly fulfilled

Then, secondly, why must the declaration be made in contrary to the law that upholds the exercise...that is not logical.

So, in my opinion, I think it's safe to revert such decision we thin seven days of revision or as may be necessary, if it was not done voluntarily or not in accordance to the law/act.

Logically, the return declaration can not be reversed if it fulfils the above two points (made voluntarily and legally).

It took years for Buhari cabal to plan for that election heist which resulted to renewal of tenure for Buhari cabal in Aso Rock through using old and sick Tinubu as front.

He was misquoted or he wasn’t coherent when saying it on Arise news channel.

He later clarified himself in a subsequent tweet.

Peter Obi is not dull. He is very intelligent and wise.

Go school you refused. Only to be hawking Gala under the bridge. Obidient will only jump on headlines without reading the body. Even as that , the electoral commission can only review itself with 7 days. Get that into your skull. So how long has inec declared Tinubu as president? Just answer that or shut up forever

It is still the same power you guys are complaining about which is the power to determine the process of announcing the winner.
If you agree with the power to return a candidate then you must agree with INEC"s power to determine a process.

I think this section is actually good, I think it should be extended to the announcement of election results too. So that INEC has enough time to review the result already announced and re-announce it.

Moreso, the clause "& 25% vote in FCT"

If only the right thing is done, we would not be having this discussion
