"...was made contrary to the provisions of the law, regulations, guidelines, and manual for the election.” The REGULATIONS AND GUIDELINES the INEC Chairman, Prof Yakubu Mahmood, declared before the election was that election results would be transmitted directly from the BIVAS to INEC iREV on real time for public viewing of the progress of the election. But the INEC Chairman deviated from the REGULATIONS AND GUIDELINES as election results were not transmitted from the BVAS on real time, but he declared a winner when the public could not access the results from the INEC portal. That must invalidate the election and results produced therefrom. 1 Like |

He is right . It is a very dangerous thing to have in our electoral act . People should not see this with sentiments . This can destroy a country . Let’s say Obi won and he was returned then Tinubu gives the inec chairman 1 billion dollars and kidnaps his kids to change the declaration and he does . The violence , and possibly war , that will start immediately would be mad . |

Sometimes, I still don't understand how lame man like me will interprete law and acts l, more accurately, even than the so called legal luminary and SANs..... The act states that: Provided that the commission shall have the power within seven days to review the declaration and return where the commission determines that the said declaration and return was not made voluntarily or was made contrary to the provisions of the law, regulations, guidelines, and manual for the election.” Two key words; 1. Not made voluntarily 2. Made contrary to the provision of law My question is, which of the two points are meant to be good reason to declare a return of certificate? It is by default faulty, to declare a winner or return of a winner involuntarily....the declaration must come under a voluntary will of diligence. Why should it come under duress, it must be done with conviction after all processes duly fulfilled Then, secondly, why must the declaration be made in contrary to the law that upholds the exercise...that is not logical. So, in my opinion, I think it's safe to revert such decision we thin seven days of revision or as may be necessary, if it was not done voluntarily or not in accordance to the law/act. Logically, the return declaration can not be reversed if it fulfils the above two points (made voluntarily and legally).
