[ARCHIVES] Supreme Court upheld candidates must win 25% votes in 24 states, plus 25% in FCT in Buhari v Obasanjo [2005]

The clarity came from a Supreme Court ruling in a case involving Muhammadu Buhari of the then All Nigeria Peoples Party (ANPP) and Olusegun Obasanjo of the then Peoples Democratic Party (PDP) on Friday, July 15, 2005.

In its ruling, the apex court had upheld that presidential candidates must win 25 per cent of all votes cast in 24 states, and the Federal Capital Territory, Abuja.

We just love to ridicule ourselves. People have suddenly turned blind and dumb to simple english.

Constitutionallly Nigeria has no president elect, but since english language is not our first language and translating the constitutional requirement for the FCT abuja has become a challenge, Let those in charge set up a committee that will consult the UK judiciary to explain what the word "AND" means.

The problem here is different interpretations has been given under different circumstances.

But the law uses "AND" FCT, which is very clear.

FCT in that clause is not regarded as one of the other states according to the electoral law.

Let's see how this plays out. But the world is watching.

This will be the first time we will be going this route so the Judges will surely give it their own interpretation.

S. 134(2): He has not less than one-quarter of the votes cast at the election in each of at least two thirds of all states in the Federation and the Federal Capital Territory, Abuja.”

The words here are "each" and "and".

Each is a distributive adjective pronoun, which denotes or refers to every one of the persons or things mentioned; every one or two or more persons or things, composing the whole, separately considered.” (SC in Eyisi & Ors v State 2000)

And is performing the function of joining two expressions or sentences which could be inseparable, integrated, joint or matched. (SC in Buhari v INEC 2008)

I think even though the SC has not ruled on the electoral status of the FCT, it will be treated as a State.

Which means fct may be part of the 24 states.

Read your constitution, what is two thirds of 36 states 24

What the Court is saying is that fct can also be counted as part of the 24 states for the purpose of fulfilling this criteria. It doesn't mean u must get 25% in fct. There's nothing special about fct in the constitution.

The Supreme Court was trying to prevent a situation where someone wins 23 states and then fct, only to be disqualified that fct is not a state. Fct is counted as a state in this case.

Bottom line: Tinubu won fair and square.

God bless you for this...If FCT is compulsory, I bet you subsequent elections in FCT will be marred with violence...A presidential candidate will just sit in Abuja campaigning without going to other states to campaign hoping to frustrate other contestants from getting 25%..Someone like Kwankwanso can do that which I think it's illogical.

Even though i am neither Obedient nor Batified, but as one of the concerned citizens who has been keenly following this brouhaha, this judgment above only upheld the fact that "the stated requirement is valid and recognized by law". A clear interpretation was however not given as this was not part of the prayers of the case. I think the supreme court will this around have to give a clear interpretation to that section of the constitution not just because of this election only but to avoid similar confusion in future elections. Please let us note that only the Supreme Court which is the policy court can interpret any section of the law

Even if the constitution says FCT voters are more Nigerian than the rest of us (which the constitution also clearly states all votes are equal), do you think Obi will be given the mandate from his third position with 25% in 12 states just because he won the FCT but failed other criteria? In all sincerity, do you think Obi will win Lagos now even if they do the election again? Think!

we have 36 States in Nigeria, Abuja is the seat of power am not a lawyer tho. Maybe you should ask weac why it's a.must for one to score at least credit in math n english before gaining admissions. This analogy was used by a barrister.
