The case is tricky. On one hand the REC is not empowered to declare her governor.

On a second hand the electoral 2022 as amended, the error of the REC declaring her as the governor elect can only be corrected by the Tribunal.

In conclusion, FINGERS CROSSED

Where is the restraining order from the Court?

APC and Banani filling a case in Court that haven't been determined is nothing until the Court acts on it and moreover, the application is riled with falsehood and misrepresentation of facts.

Aisha Binani, Senator Elisha Aboh and all their scallywags, should read Section 65 of the Electoral Act. It is within the powers of inecnigeria to review the travesty, the rape and crass impunity in Adamawa.
No sensible judge should entertain that exparte.

Section 65 states:
(1) The decision of the returning officer shall be final on any question arising from or relating to—

(a) unmarked ballot paper;

(b) rejected ballot paper; and

(c) declaration of scores of candidates and the return of a candidate:

Provided that the commission shall have the power within seven days to review the declaration and return where the commission determines that the said declaration and return was not made voluntarily or was made contrary to the provisions of the law, regulations, guidelines, and manual for the election.

(2) A decision of the returning officer under subsection (1) may be reviewed by an election tribunal or court of competent jurisdiction in an election petition proceedings under this Act.

This is the law! INEC has the power to do what they did yesterday

By virtue of Section 65 of the Electoral Act, 2022, INEC can now, within 7 days, review results declared by a returning officer under duress or where such a declaration was made contrary to the provision of the law, regulations and guidelines, and manual for the election. This is without prejudice to the jurisdiction of a court of competent jurisdiction or election tribunal to review the decision of the returning officer.

Did the electoral act empower any INEC staff to declare anybody winner even when a returning officer is on ground?

Which takes precedence, INEC act or the electoral act?

1. As far as INEC and PDP is concerned, no winner was declared by INEC. The REC is just like everyone else regarding declaration of results and winners, his announcement is equal to any other person saying Binani has won.

This is just illegality taken too far, and Binani is destroying whatever she has left of goodwill, many people didn't vote for her because of who she is but against Fintiri and given the lengths she is going to justify this sham, she may go the way of Mama Taraba - lose the governorship and her way in politics.

And once again, Nigerian judiciary is at crossroads, with the way exparte motions are just awarded for every silly concern, we may wake up and day and a court will stop the president from being the president because of an exparte order. Absolute nonsense.

How can a court restrain INEC, over an election that hasn't been concluded?
11 of 20 local governments have been declared, according to report, with Fintri, leading the APC candidate with 2,000 votes, if the declaration was to stand, what is the fate of the votes in the remaining undeclared 9 local governments?
NBA and Buhari, must act against this action,in other not to set this nation on fire.
There are repots, alleging corruption and support from Aso Rock over this matter.
The will of Adamawa People must be allowed to prevail. To Aisha Buhari and her husband, this must not be negative parting gift to Adamawa people.

The judiciary will set Nigeria ablaze soon and if it starts from the north we are safe down south.

You see the reason they do everything to be declared winner whether legally or illegally and after the declaration they will say go to court because they know the judiciary has been seriously compromised
